Landlord served me eviction notice after I renewed lease. What are my rights?

Hello,

I recently renewed my rental contract at the end of May, but I was served an eviction notice today (June). The reason given was that the property is being sold, but I believe that the landlord wants to rent it at a higher price.

He refused to abide by the RERA index, so I had to keep renegotiating for a fair rate. When I first moved in, the apartment had a previous owner who sold the unit to the current landlord, but the landlord did not evict me.

This is why I believe that the current landlord is not actually selling the unit. I was happy to renew the lease, and I have been a good tenant and understanding towards the landlord.

Could you please assist me with this matter?

Dear,

If your landlord requests to retrieve the property for the purpose of selling it but rents it instead, you shall have the right to claim compensation if you can prove that he is renting it out to someone else.

Would it be possible to contest this eviction as I believe it is being done on unfair grounds?

I have been in the property for 3 years and have been such a great tenant.

Dear Questioner,

If the notice to vacate is official, and it is for 12 months, you must vacate the property.

After the eviction, if the landlord does not sell the property, you will have the right to file a compensation case, and the compensation in these cases is good.

Hi,

If the landlord has given you the notary eviction notice, you will have to evict the property after the notice period.

However, if you get to know that the landlord has not sold the property and put it on the rent, you can file a complaint with the Tribunal in the RDC.

You will have to visit the RDC with all the evidences and inform them about the situation. However, this should be done only when you certain and have proof that the property is not sold and rented again at higher rent.

If he served a valid eviction notice for the reason of sale and the landlord is not actually going to sell it, then you don't have to leave the apartment.
