Q: I had a bounced cheque case with a bank, for which I was sentenced to 2 years in absentia. However, I made a one-time full payment and final settlement with the bank and paid them the amount. Will the sentence get removed? How do I get it removed?

Q: I have some cases pending against me for a bank loan and a bounced cheque in 2010, 2011 & 2012 respectively. I have the case numbers but wanted to clarify the costs and time frames associated with getting these paid and my name cleared from the judicial and CID system?

س: السيدة نيكحات، أنا في الهند. برجاء إبداء المشورة حول مشكلة مستمرة معي منذ العامين الماضيين بدون أي سبب، أو يمكنكِ القول بأني أعاني دون خطأ مني. لقد أصدرت شيكات في تسوية قضية مدنية لقريبي. كانت المطالبة بمبلغ 2.2 مليون درهم إماراتي مقسمة على 12 شيك بقيمة 20 ألف لكل شيك، وباقي المبلغ 1.7 مليون درهم إماراتي تقريبًا يدفع في خلال 13 شهرًا. كتب في الاتفاقية بوضوح أنه بمجرد أن يحصل قريبي على دفتر الشيكات الخاص به من البنك، سيتم استبدال جميع شيكاتي بالشيكات الجديدة. وحيث أن قريبي قد انتهت تأشيرته، فقد استغرق اصداره لدفتر الشيكات الخاص به شهرين. رفض محامي الطرف الآخر أن يستبدل الشيكات الخاصة بي، وقال أنه إذا أردت أن أستبدل الشيكات، فسوف يحتفظون بشيكاتي كضمان. لذا، فلم نتمكن من استبدال شيكاتي بالشيكات الجديدة. قام بإيداع شيكاتي في البنك لصرفها وغادرت البلد في أغسطس 2016. أنا لا أزال خارج البلد، وقريبي في الإمارات يحاول تدبير المبلغ دون جدوى. لقد خسرت سنوات خبرتي الاثني عشر في دبي ولا أزاول أي عمل الآن. لا أدري هل سأواجه أي مشاكل في الهجرة إلى قطر أم لا.

Q: Salam, I have a genuine request to everyone, please reply for the sake of humanity. I had borrowed a personal loan from the bank in 2017 which I could not pay at a later stage. A police criminal case was filed against me and I paid the fine. Years later, a civil case was also filed thus the travel ban. I somehow requested the bank to look into the matter, and they did not give me any discount but gave me installments to pay. I paid a 45k down payment against the outstanding of 115k and now I am paying 3k every month. On the 31st of December, we received the court verdict which was in my favor. Now the bank is insisting on me to withdraw the appeal as per my understanding after signing the agreement and they were supposed to withdraw the case against me. Now they are forcing me to take back the appeal since I am eligible for the court fee refund. If I withdraw the appeal, I will lose my money. Kindly advise what I should do. The bank is threatening to put a travel ban on me.

The provisions of this Decree by Law amend the Federal Law No. (18) of 1993 by replacing Clause (4) of Article (379) as well as Articles (600), (617), (641), (642), (643), (644), and adding new articles numbered (635) Bis, (641) Bis (1), (641) Bis (2), (641) Bis (3), (641) Bis (4), (643) Bis (1), (643) Bis (2), (644) Bis (1) and (644) Bis (2). The Decree-Law also repeals Articles (401), (402) and (403) of the Federal Law No. (3) of 1987.

The provisions of this law, promulgating UAE Civil Code, govern the civil transactions in the United Arab Emirates. The commercial transactions remain subject to the laws and regulations applicable in their regard.
