حساب بدل الإجازة بموجب عقد العمل الإماراتي

س: سيدتي العزيزة، إن عقد العمل الخاص بي هو عقد غير محدد المدة بالمنطقة الحرة لجبل علي. تم إنهاء خدمتي بشكل تعسفي في 09 ديسمبر 2018، وبعد أن قضيت فترة الإشعار المدفوعة لمدة 90 يومًا، انتهت فترة عملي في 08 مارس 2019. أنا الآن بصدد الحصول على استحقاقات نهاية خدمتي، وهناك استفسارات فيما يتعلق بالأساس الذي يستند إليه حساب الاستحقاقات. والاستفسارات كالتالي: الدفع مقابل الإجازة بسبب إنهاء العمل: لديّ 25 يومًا من الإجازات غير المستغلة التي أرغب في تحصيل قيمتها. ما هو الأساس الذي يستند إليه حساب قيمة هذه الإجازة المدفوعة؟ هل سيكون على أساس: أ‌) إجمالي الراتب الشهري (والذي يتضمن آخر راتب أساسي + بدل السكن + بدل الانتقال) ب‌) أو على أساس آخر راتب أساسي + بدل السكن ج) أو على أساس آخر راتب أساسي؟ هل يمكنكِ أن توضحي لي وتزوديني بآخر تحديث صحيح للفقرة رقم 79 من قانون العمل الإماراتي للاطلاع على التفسير الصحيح للأساس الذي يستند إليه حساب أجور الإجازات المذكورة أعلاه.

Leave entitlement in case of less than one year of service

Q: I have a couple of labour issues. I worked for a company for 7 months, and I was lied to regarding my visa status while I was working. It was said it was possessing while it was not, and I also received a false labour contract which I later found out. Once I finally received my visa, I had a death in the family so I wanted to take my emergency leave. My employer said it will be an unpaid leave, so I replied I thought I can get 30 days paid leave after my probation period, then he replied bring in your passport for termination. I just needed to leave the country for 2 weeks for the funeral even if he would have said that he could not pay for the leave it would be ok, but by terminating me instead, I thought it was a wrongful termination. When I came into the office they told me it was because of poor work performance, which was not true because I never received a prior documented notice with my signature regarding poor work performance. What legal actions can I take towards this case?

Request for legal guidance regarding employer harassment and premature asset retrieval demand (1)

Respected Law Team Members, I am writing to seek genuine legal advice and guidance for our friend regarding an ongoing issue with her employer. On 23rd May 2025, she received a termination notice via WhatsApp from her sponsor, which clearly states that she is required to complete her handover by 20th June 2025. Since receiving the notice, however, her sponsor has been repeatedly contacting her via WhatsApp and phone calls, pressuring her to immediately return the company laptop and office cabinet keys, despite the agreed-upon handover date. In addition, she has been verbally accusing my friend and making threatening remarks, creating a hostile environment, and causing her emotional distress. To clarify her legal position, she contacted MOHRE, who advised her to reshare the termination notice to the lady employer about the handover date (20th June 2025) as she outlined in the (Cont-1)

How can my kids learn about their father's condition without contacting his family?

Good morning, I have two kids. Their father is in critical care and is not able to communicate, and we have been divorced for more than seven years. The other side of the family is not communicating with the kids about the father's whereabouts for them to visit him, and they have not been in touch with the kids for the past two weeks due to family issues that took place in court regarding guardianship of the kids. Canceling my MoU and getting my deposit back due to a low bank valuation and overpriced property

Hi, I wanted to purchase a 2-bedroom apartment in JVC Dubai. I gave a 10% security deposit cheque to the seller. The price mentioned in the MoU is very high compared to other similar apartments in the same building. The bank’s valuation also came in very low. Since the valuation is much lower, how can I terminate the MoU and get my cheque back? The MoU ends on 1st October 2024. One of the articles in the MoU states: In the event that the Buyer fails to make the payments as agreed or fails to complete the transfer on the agreed date due to his own acts or omissions, the Seller has the right to terminate this agreement and retain the deposit, provided that the termination is due to a violation of the agreed terms, unless both parties agree amicably to different dates. I need help urgently.

How is the probation period calculated exactly from the date of signing the contract?

Regarding the probation period, when is the deadline for an employer to terminate me if the DOJ anniversary is Friday 2nd Feb? Will the six-month period end at midnight on the 1st, therefore completing six months, or can the employer still terminate on the 2nd? Appreciate any guidance provided.
