Q: In regards to the UAE Labor Law and the application of End of Service Gratuity, if an individual was employed by another branch of a company before transferring to an FZE branch UAE based employment contract, would that be considered continuous employment?
For example, the initial employment was in another Middle East location(s) within a European registered branch; however, all administration (HR / Management oversight) was conducted by FZE entity, after which, in acceptance of promotion, a relocation to the UAE and an FZE contract was entered.

س: كنت أعمل في فرنسا لصالح شركة وتم نقلي إلى الإمارات مع نفس الشركة. كجزء من عملية النقل، استقلت من منصبي الفرنسي ووقعت عقدًا محليًا جديدًا للمنصب الجديد.
أصدر صاحب العمل خطابًا يذكر فيه الاستقالة ومزايا المنصب الجديد بالإضافة إلى الإشارة بوضوح إلى أن عملي في الشركة مستمر (أي أن تاريخ البدء مع الشركة لا يزال هو نفسه تاريخ البدء في فرنسا).
لقد استقلت الآن من منصبي في الإمارات وأنا في منتصف فترة الإشعار.
لقد ناقشت مع قسم حسابي تفاصيل مكافأة نهاية الخدمة ووجدت أنهم لا يأخذون في الاعتبار تاريخ البدء الفرنسي ولكن تاريخ بدء الإمارات العربية المتحدة في حساباتهم.
ينص الخطاب بالإضافة إلى الإجراءات الداخلية المتعددة للشركة بوضوح على أنه عند حدوث نقل داخلي، يحسب تاريخ الالتحاق منذ البداية.
نظرًا لأنني أُجبرت على الاستقالة من عقدي الفرنسي، لم أحصل على أي مكافأة عن سنوات العمل.

س: أنا أعمل لدى شركة تابعة لمركز دبي للسلع المتعددة. لقد انتهت صلاحية تأشيرتي بالفعل في 8 نوفمبر. أخبرتني الشركة التي أعمل بها أنهم سيقومون بنقلي إلى شركة ذات مسؤولية محدودة (مملوكة لنفس المالك). لقد راسلتهم عبر البريد الإلكتروني لتذكيرهم أنه بالإضافة إلى مكافأة نهاية الخدمة، يحق لي أيضًا الحصول على بدل تذاكر الطيران غير المدفوعة.
لكنهم أرسلوا لي خطابًا مفاده أنه سيتم نقلي من مركز دبي للسلع المتعددة إلى شركة ذات مسؤولية محدودة بسبب انتهاء صلاحية تأشيرتي. وأنه سيستمر عملي معهم بدون أي تغييرات فيما يتعلق بمكافأة نهاية الخدمة والإجازة السنوية.
هل هذا الخطاب يُعد قانونيًا؟ هل سيكون هذا الخطاب دليلاً وتأكيدًا كافيًا على أنني في نهاية الخدمة سأحصل على مستحقاتي من الشركة الأخيرة (الشركة التابعة لمركز دبي للسلع المتعددة)؟

Transferring EOSBs from Dubai Internet City to Dubai International Financial Centre?

Q: Dear Sir/Madam,
Can you assist us with our query?
Our company is initially registered in Dubai Internet City (DIC) and will be transferred to Dubai International Financial Centre (DIFC).
Can we transfer the employee's accumulated end-of-service benefits (EOSB) while in the DIC to DEWS contribution?
Or is it not possible and we need to pay the EOSB first to the employee and start anew with the DEWS contribution?

I recently joined a new organization in the Hamriyah Free Zone, and my previous organization has not released my end-of-service benefits.
The HR has instructed the finance team not to do so because I had contacted one of their clients.
In my DMCC contract, there is no Non-Compete clause, but the offer letter has one, and now they are not releasing the end-of-service.
Is this legal? What are my rights?

My trade license and visa will expire next month, along with my Emirates ID.
Is it possible for me to renew my license and visa along with EID prior to settling the execution cases?
The trade license and visa were issued by the free zone authority.

I already have a dispute order with MOHRE. Then my employer became willing to settle the case.
What should I do in case they do not follow through with the promised amount to pay?
