لقد وقعت عقدًا لمدة عامين في شركة ذات مسؤولية محدودة. والآن أنا في فترة اختبار. يجب أن أترك وظيفتي وأنتقل إلى بلدي.
هل من الممكن الاستقالة خلال فترة الاختبار؟
هل أحتاج إلى تعويض رسوم فسخ العقد مع صاحب العمل؟

س: سيدي/سيدتي العزيزة،
وفقًا للبند 3 من المادة (9) من المرسوم بقانون اتحادي رقم 33، إذا رغب العامل في الانتقال خلال فترة الاختبار للعمل لدى صاحب عمل آخر في الدولة، فعليه إخطار صاحب العمل الأصلي بذلك كتابيًا خلال مدة لا تقل عن شهر واحد من تاريخ رغبته في إنهاء العقد.
عندها، يعوض صاحب العمل الجديد صاحب العمل الأصلي عن تكاليف الاستقدام أو التعاقد مع العامل، ما لم يتم الاتفاق على خلاف ذلك.
ماذا تعني "تكاليف الاستقدام أو التعاقد"؟
لقد استقلت بعد خدمتي لمدة 5 أشهر وأعطيت فترة إشعار مدتها شهر واحد أيضًا.
يطلب صاحب العمل الحالي راتب 6 أشهر من صاحب العمل الجديد لأنه وفقًا له، فإن راتب فترة الاختبار هو أيضًا جزء من "تكاليف الاستقدام".
يرجى تقديم المشورة.

س: لقد استقلت من وظيفتي أثناء فترة الاختبار وخدمت شركتي فترة الإشعار مدتها 15 يومًا بناءً على البند التالي:
"يجوز إنهاء هذا العقد قبل انتهاء فترة الاختبار من الطرفين (إشعار مدته 14 يومًا تقويميًا على الأقل) وبدون سبب. إذا رغب الموظف في تقديم إشعار بإنهاء العقد أثناء فترة الاختبار من أجل الانضمام إلى موظف آخر في دولة الإمارات، يجب على الموظف أن يقدم لصاحب العمل إشعارًا كتابيًا مدته 30 يومًا تقويميًا على الأقل، ولا يحق للموظف الحصول على أي مكافأة نهاية الخدمة إذا تم إنهاء الخدمة أثناء فترة الاختبار.
وافقت شركتي ووقعنا على تسوية مع عدم التزام أي من الطرفين بأي شيء للآخر وتم إلغاء تأشيرتي.
لم أحصل على وظيفة حتى الآن، ولكني أردت أن أعرف أنه إذا قبلت وظيفة بعد ذلك، وخلال فترة السماح الخاصة بي، هل من الضروري أن أتصل بصاحب العمل السابق.
نظرًا لأنني لا أرغب كثيرًا في إشراك صاحب العمل السابق في هذه التفاصيل.

Can I resign during probationary period without paying compensation?

Q: Dear Sir/Madam,
I am on a limited contract (I think, as it does not contain an end date but states a duration of 3 years). I am one month into a 6-month probationary period and I wish to resign.
I am happy to serve the required notice period (14 days as stated in the contract), but I wish to understand if I will be liable to pay the employer compensation for resigning within the 3 years.

Does the existing tenancy contract between the tenant and the previous owner remain in force even after the new landlord has purchased the property in the middle of an ongoing lease?
And when should a new tenancy contract be made?
Should it be made immediately after the property has been sold, or at the end of the ongoing tenancy contract signed between the previous owner of the property and the tenant?
Also, does a new contract have to be in place for the tenant to exchange the cheques, or does the existing tenancy contract with the previous owner remain valid for the purpose of exchanging the cheques?

Evicting an employee from school accommodation while a labor case is pending 2
Dear Sir/Madam,
I was wrongfully terminated by my school under Article 44 on March 20th, 2023. I have a case in the labor courts, and the first hearing is on April 4th, 2023.
However, my employer is asking me to vacate the school accommodation. I asked the Ministry of Labor and the courts, and they informed me that the school cannot evict me until the case is resolved.
Is this information correct?
I am currently unemployed and have nowhere else to go until I find another job.

Hi,
May you and your family be blessed.
I'm extremely tense and need your kind feedback on the following issue.
If I have a travel ban in KSA, can I travel to the UAE on a work visa?
I have been visiting Dubai on a tourist visa without any problems.
The ban was imposed because I had to leave KSA suddenly and could not return after an exit-entry, and I was unable to pay back my car EMI and credit card payment totaling 30k SAR, which I intend to pay off gradually now.
When I left KSA, they only had my fingerprints at the time. I also understand that while coming for a visit to Dubai, only a retinal scan is done.
On the other hand, when obtaining a work visa, UAE takes and registers fingerprints as well. Could this lead to any issues for me?
I have finally obtained a better-paying job after a long time and can finally save up to pay off my debts. The case registered for which the travel ban is imposed is only for SAR 16000.
As of now, I cannot afford to hire a lawyer to check in UAE.

My landlord wants to evict me from the property where I reside. They have not provided a court order for eviction within the past 12 months.
Additionally, they are requesting a 40% increase in rent and are insisting on a 6-month fixed-term renewal, despite the RERA index indicating no such increase.
Furthermore, they have included an unreasonable clause that prohibits pets, even though I have lived on the property with a pet for over three years.
What options do I have if I do not agree to these demands?

Can the landlord send me an eviction notice for non-payment despite submitting an offer and deposit at RDC? 0
I’ve lived in my building for over 4 years, with the most recent rent being AED 50,000. Each year, the management collects cheques and extra AED 2,400–2,500 cash (no receipt) for management and Ejari fees.
My contract was due for renewal on 15 Feb 2025, but management delayed, demanding a 10% rent increase even though no formal 90-day notice and the RERA index did not allow it.
After a month of excuses, the manager called on 12 March, insisted increase to 55K, and threatened eviction if I refused. When I referenced RDC, he hung up. The next day, he again made unprofessional remarks, so I decided to go with RDC.
I submitted my offer and deposit on 13th March, but the management didn’t respond. The case went to the judge on 14 April he ruled in my favor.
On 30 April, I applied for the execution of the ruling, and RDC says I can renew Ejari only on 8th May at DLD with cheques given to them.
However, on 1st May 2025, I received a notarized eviction notice for non-payment of rent and communication.
My question is, what will happen at DLD now?

I am working in the private sector, and currently I am in the probation period. I got a government job, so I submitted a one-month resignation notice.
My current company rejected my one-month notice and ordered me to serve a three-month notice (as per the contract).
I enquired with One Time Centre, and as per their advice, after one month, I can stop work and register a complaint against my company.
For this matter, how will the UAE law help me to solve it?

Can the employer force the housmaid to work for unlimited hours without rest? 0
Hi
I'm a nanny, and at the same time, I work as a housemaid (khadama) here in the house. I work, but as I know, the nannies and housemaids have different rights, and my employer doesn't give me rest.
My work starts at 7:30 am and then finishes at 10 pm or less. It depends on whether the baby is asleep or what time they will take on me if not yet asleep. Is this right?
Also, at the time of eating, I'm still working because the baby is with me, so I just let her sit in her chair. That's how I eat.
Please answer me. I want to know my rights.
Because if I can leave during the 6-month probation, I want to take it if the employer is this kind. I don't know.
They are also expats, but they don't follow the rules of the UAE regarding a housemaid.
