س: الشركة المدنية التي كنت اتعامل معها بها شريكان. كل شريك هو أيضًا مديرًا للشركة.
أرسلت الشركة المدنية إليّ كشف حساب ورسالة تقر بالديّن. أكدوا كتابيًا أنهم سيدفعون لي 153,500 درهم إماراتي في 10 سبتمبر 2021.
الرسالة مكتوبة على ورق الشركة الرسمي وبها إمضاء أحد المديرين / الشريكين في الشركة.
ولكنهم لم يدفعوا لي حتى الآن.
أرغب في تسجيل قضية بشأن أمر الدفع أو أمر الأداء (أمر على العريضة) ضد الشركة حيث تم تأكيد حقي كتابيًا دون قيد أو شرط.
سؤالي هو؛ هل يجب عليّ رفع قضية ضد الشركة المدنية بصفتها مدعى عليه، أم يجب أن أذكر أيضًا المديرين / الشريكين بصفتهما مدعى عليهما، أي ما مجموعه ثلاثة أشخاص مدعى عليهم؟

الطريقة الصحيحة لتسجيل قضية ضد شركة مدنية لاسترداد الأموال المستحقة
س: هناك شركة مدنية تدين لي بالمال. ولقد أصدروا إقرارًا كتابيًا بالديون. أريد رفع قضية أمر أداء ضد الشركة.
نظرًا لأنها شركة مدنية، ينص القانون على أن المدير والشريك مسؤولان عن سداد الديون من أصولهما الشخصية في حالة عدم قدرة الشركة على الدفع.
سؤالي هو:
هل يجب عليّ تسجيل الشركة المدنية وحدها باعتبارها المدعى عليه؟
أم يجب أن أسجل اثنين باعتبارهما المدعى عليهم في القضية: الشركة المدنية باعتبارها المدعى عليه الأول والمدير أو الشريك بصفته المدعى عليه الثاني؟

Can one month in jail cover multiple execution cases for a manager?
Q: Dear Lawyers,
How to Calculate Jail Terms
I have 4 execution cases against a company and want to put the manager in jail. I also have an execution against the manager directly, in his personal capacity.
Another creditor has two execution cases against the same company and wants to put the same manager in jail. The other creditor also has an execution case against the same manager, in his personal capacity.
Suppose we, two creditors, succeed in getting 6 arrest warrants against this manager since he is the manager of the company. And we also succeed in getting two arrest warrants due to personal execution directly against the manager in his personal capacity.
Question 1: Can the same one month in jail be counted against multiple execution cases?
Question 2: Can the manager be in jail for 3 months maximum in his role as manager, and then 3 months contiguously in his personal capacity?
Question 3: Is it better to stagger the application for arrest warrants, or is it better to apply for all 8 arrest warrants at the same time?

Hi,
I wanted to purchase a 2-bedroom apartment in JVC Dubai. I gave a 10% security deposit cheque to the seller. The price mentioned in the MoU is very high compared to other similar apartments in the same building.
The bank’s valuation also came in very low. Since the valuation is much lower, how can I terminate the MoU and get my cheque back? The MoU ends on 1st October 2024.
One of the articles in the MoU states:
In the event that the Buyer fails to make the payments as agreed or fails to complete the transfer on the agreed date due to his own acts or omissions, the Seller has the right to terminate this agreement and retain the deposit, provided that the termination is due to a violation of the agreed terms, unless both parties agree amicably to different dates.
I need help urgently.

Regarding the probation period, when is the deadline for an employer to terminate me if the DOJ anniversary is Friday 2nd Feb?
Will the six-month period end at midnight on the 1st, therefore completing six months, or can the employer still terminate on the 2nd?

Respected Advisors,
I have been involved in a few criminal cases since 2017, but all of them were cleared by this year. I have obtained release letters for all the cases from the public prosecution office through an online portal.
Recently, I also received my residence visa. After the visa process was completed, I applied for a PCC online. However, the request was rejected.
I contacted the 901 office, and they advised me to visit the CID. I arranged for a power of attorney to be granted along with all the necessary documents to update the system.
Twice I was told to come in person, but I am hesitant to do so because of my previous negative experience.
Could someone please advise me whether I must go in person or if the person holding the power of attorney can handle the process?

How can the heirs of a deceased person distribute his shares if there is a minor?
My father died recently. We are Muslim residents in Dubai. I have siblings including a minor who is 16 years old. My father has land and vehicles under his name.
If I am applying for inheritance, does the minor need to have a share in ALL the properties and vehicles or can she be given a particular property/vehicle?
Secondly, if we want the land to be in her name, and she manages it (like renting and bank), does it require an adult?
Can the vehicles be transferred to someone else’s name without including her?

ما هي الكلفة لفتح ملف تنفيذ في الشارقة لقضية طلاق وكم من الوقت سيستغرق تنفيذ أمر المحكمة؟
أخبر زوجي المحكمة أنه لا يملك المال لدفع نفقتي ونفقة ابنتي لأنه يكسب مبلغًا أدنى لا يستطيع العيش إلا به.
في هذه الحالة، ماذا يمكنني أن أفعل؟
لقد أغلق جميع حساباته المصرفية وأرسل الأموال إلى والديه في الهند. كما أخبرني أنه سيثبت في المحكمة أنه ليس لديه وظيفة أو مال، وبالتالي لا تستطيع المحكمة أو الشرطة فعل أي شيء له.

I received a termination letter from my company for restructuring. Is this considered arbitrary dismissal?
I received a termination letter from my company on January 31st, 2025, with a one-month notice period, stating my last working day as February 28th, 2025.
The reason given for the termination is "considering the current business scenario, the company has considered measures to reorganize the business."
Could this be considered arbitrary dismissal?
Am I entitled to any compensation or benefits from the company as a result of this termination?

Do I need to hire a lawyer if I found I have a marital case against me in the court?
By checking in Al Adheed, I have found there is a marital matter case against me in Dubai Courts. There is a hearing date for next week and the time mentioned in the case status with a link for an online hearing.
However, I have not received any message from Dubai courts regarding this by mail or phone. I have all contact details updated with EID. In this case, what should I do?
I don’t know what the case is about.
Should I hire a lawyer or I can attend the hearing by myself?

Can I file a case against a friend for privacy breach if he claimed I scolded him for his act?
On Jan 2, 2025, one of my close friends did a privacy breach and recorded me and my van in some specific place.
On Feb 5, when I called and asked him why he did this to me, he went and gave a complaint that I scolded him and threatened him.
