س: مرحبًا، رفض المستأجر لديّ زيادة الإيجار القانونية التي قررتها مؤسسة التنظيم العقاري وطلب مني البحث عن مستأجر جديد. ولكن بعد أسبوعين، غير رأيه ورفض إخلاء العقار أو دفع الزيادة، ويقول إن المدة المتبقية على نهاية العقد أقل من 90 يومًا وأنني لم أرسل له إشعارًا بواسطة الكاتب العدل. إذا رفعت قضية ضده أمام مركز فض المنازعات الإيجارية، مّن سيدفع كافة رسوم المركز وأتعاب المحامي؟ هل يجب عليه دفع رسوم مركز فض المنازعات الإيجارية وأتعاب المحامي حيث أنه يجب عليّ سداد رسوم المركز أولاً لبدء الإجراءات؟

As far as I know, they need to serve a formal notarized notice, stamped by the courts and delivered by Aramex, Emirates post or any registered mail/postal services for us to vacate the property. Can we stay because they didn't send the notarized notice through postal services? Or should we vacate the property?

Q: Hello, Landlord sent an eviction note by email asking to confirm it by email as well. I already confirmed by email that I received her email. It has been 12 months and she is claiming that she wants to move into the apartment. I read several threads; some say that her claim does stand as it is similar to registered mail, while others say it has to be an official registered mail. From common sense, the landlord did get a confirmation that the tenant acknowledges receipt of the intent of eviction. From a literal legal perspective, she did not use registered mail. I suspect that this situation is frequent and I would like your experience based on what is recently happening in courts, and not only an interpretation of the law, as the concern is that two judges might interpret this part of the law differently.

Q: Dear Lawyers, I just renewed our rent for a third year on September 4th. Today, October 11th, the landlord sent a screenshot through the agent, apparently from the Dubai Court, stating a judicial warning to vacate the property in 12 months, without mentioning a reason for the eviction. The provisions of this Law apply to real property leased out in the Emirate of Dubai, including vacant and agricultural lands, but excluding hotel establishments and real property provided by natural or legal persons as accommodation to their employees at no charge.

This Decree determines the maximum percentage of rent increase for real property in the Emirate of Dubai when renewing lease contracts.
