س: مرحبًا،
أنا أستأجر فيلا في إمارة دبي منذ شهر يوليو 2020. بالإضافة إلى عقد "إيجاري"، قمت أيضًا بتوقيع ملحق مع المالك ينص على أنه يجب عليّ إبلاغه قبل 90 يومًا على الأقل من انتهاء العقد برغبتي في تجديد العقد أو إخلاء الوحدة.
انقضى الموعد النهائي لإرسال الإشعار ولم أبلغ المالك برغبتي في تجديد العقد. قبل بضعة أيام (بعد الموعد النهائي لإرسال الإشعار)، طلب المالك إخلاء الوحدة عند انتهاء العقد، حيث أنه سيقوم ببيعها.
ينص قانون دبي على أنه يجب إرسال إشعار بعدم التجديد قبل 90 يومًا من انتهاء العقد. في الوقت نفسه، لم ألتزم بالشرط الوارد في الملحق والذي ينص على إبلاغ المالك برغبتي في التمديد.
ما الذي سيطبق في هذه الحالة؟ هل يمكن للمالك استخدام الملحق كأساس قانوني أم سيسود قانون دبي وسيتم "تجديد العقد تلقائيًا"؟

انتهى عقد الإيجار في 31 يوليو 2019 وأبلغ المستأجر وكيل أعمالي أنه يرغب في المغادرة عند انتهاء مدة العقد.
ومع ذلك، لا يزال يعيش في شقتي ويرفض إخلاء العقار أو تجديد العقد. ولقد نصحتني دائرة الأراضي والأملاك في دبي بإعطائه مهلة 30 يومًا عن طريق كاتب العدل.
كم ستكون تكلفة إرسال مثل هذا الإشعار؟ أنا مقيم في المملكة المتحدة.

من المقرر أن يغادر المستأجر شقتي في نهاية هذا الشهر وفقًا لتواريخ الاتصال.
يقولون الآن أنهم بحاجة إلى أسبوع إضافي قبل الإخلاء بسبب عدم قدرتهم على توفير شركة النقل.
أعتقد بشدة أنهم سوف يؤجرون من الباطن لهذا الأسبوع الإضافي لأن هذا ما فعلوه مع المالك السابق.
أريدهم أن يخرجوا حتى أتمكن من الانتقال في أسرع وقت ممكن. من فضلك ما هي خياراتي لإنجاز هذا؟

If my landlord is not responding to my emails and calls, how can I renew the contract?

Q: Hi,
My landlord sent an email mentioning that the rent will be increased for next year; however, the new rent amount was not specified in the email. The email was sent in accordance with the 90-day notice requirement.
When I called the landlord's office, I learned the rent amount, which was more than a 15% increase and not in line with RERA regulations. According to RERA, the rent can only be increased by a maximum of 10%. My tenancy contract will expire on February 4, 2025.
My questions are:
1. If my landlord is not responding to my emails and calls, how can I renew the contract?
2. When can I renew my contract if it’s expiring on February 4, 2025?
3. How many days or months in advance can I renew it?

Q: Hi,
I am a landlord and need advice on the following scenario.
- The contract with my tenant expired in Sep 2024. Upon requesting the renewal, the tenant mentioned that she is out of the country and will sign the renewal contract and provide the rent checks. In the meantime, she paid the first quarter of rent through a bank transfer.
- After 3 months, when the next quarter's payment was due, she deposited the next quarter's rent into my bank but did not sign the contract renewal despite my follow-up with her multiple times. At this time, she had returned to Dubai.
- Now the next quarter payment is due, however, the tenant is not responding to WhatsApp or answering calls. She is NOT paying rent or renewing the contract.
What action can I take since she is not answering my calls or messages?
She does not have a valid contract or Ejari, and her rent is delayed by 1 month. All WhatsApp messages are delivered, but she chooses not to respond.

I'm a tenant of an apartment and a new owner has purchased the apartment. I would like to know:
1. Should I revise the Ejari by canceling the previous one and applying for a new one?
2. My current rent is 35% less than the current market value. Can the new owner change the rent as per the market value, or he still has to follow the RERA Index calculator for a new contract?

I'm staying in JLT in a house with a rent of AED 140,000 per year. The lease starts on 1st Sep '23 and expires on 31st Aug '24.
The landlord sent me a legal notice from the Dubai Courts in mid-Sep '23, giving me 1-year notice to vacate the house as he plans to sell the house. The notice was received by me through email from the court.
He claims the email notice sent by the court is not valid till I receive it by courier via Aramex for my physical signature. Can you please confirm if this is true?
The landlord is now ready to let me stay in this house for two more years. He has proposed that we maintain the existing lease agreement and Ejari. However, I should pay him AED 14,000 in cash (10% increment).
We will sign a separate paper document wherein we will agree that I will further rent increase of 10% (10% on (140,000+14,000)) on 1st Sep'24 when my current lease expires.
Should I insist on making a fresh written contract with the higher rent (140,000+14,000=154,000)?

I have signed Form F and got the mortgage but the seller is in breach. What to do? 0
Hi
I have signed the MOU Form F since July 2023 and we prepared all the papers and the loan from my end on 23/8/2023.
When I went to DLD for the transfer, the seller had registration issues and asked for some papers to be provided as the property is under the company not an individual.
Since that time, we have kept renewing the MOU every month in the hope of finalizing but I am not seeing any progress.
So I am asking about legal action as I already got a bank mortgage and started paying as well but not seeing any progress from the seller.
So I need to ask the following:
1. If my MOU expired on 20.11.2023, can I file a complaint on 20 or after a couple of days like 23?
2. What will happen in terms of 10%? Will it be returned and what about the fees paid to the bank like mortgage fees, evaluation, and cancellation of loan? Will the EMI payment be compensated by the seller?
3. What is your advice?

I received a termination letter from my company on January 31st, 2025, with a one-month notice period, stating my last working day as February 28th, 2025.
The reason given for the termination is "considering the current business scenario, the company has considered measures to reorganize the business."

By checking in Al Adheed, I have found there is a marital matter case against me in Dubai Courts. There is a hearing date for next week and the time mentioned in the case status with a link for an online hearing.
However, I have not received any message from Dubai courts regarding this by mail or phone. I have all contact details updated with EID. In this case, what should I do?
I don’t know what the case is about.
Should I hire a lawyer or I can attend the hearing by myself?
