Q: Hello.
I hope I can get some good insight from you. I have tried to reason with my landlord to allow me to break my tenancy contract early. He refused.
Now what legal action can I take, and can I refuse to pay the full amount as too many shortfalls in the building? It is very dirty, never cleaning, the gym is so dirty one may get a disease, faulty equipment, very bad maintenance, a pool no one can access... so many.
What can I do about it? Can I refuse to pay the whole amount? Who can I complain to? I need some info to know what to do.

Terminating a tenancy contract by a tenant because of smoking neighbors

Q: Hi,
I have spent just 1 month here in my new apartment with my wife and my 6 months old baby. Our neighbor is smoking inside their flat and the smoke comes inside our flat. We have already complained about it to the management and the management keeps only warning them.
I have a baby who is at risk for smelling cigarette smoke and we've found out that the tenant has many complaints already. The management seems very soft to them. Are we allowed to break our tenancy since the management fails to control them?
I think they have a friend who is a senior manager of the building and that's why they keep on doing crazy things without eviction.
Can we terminate our contract for this reason since we have a baby?

لقد وقّعت عقد إيجار فيلا في إمارة دبي بتاريخ 1 نوفمبر. لقد دفعت 5٪ وديعة للمالك و5٪ رسوم للوكيل العقاري.
في الوقت الحالي، بينما بدأنا مناقشة التفاصيل المتعلقة بالانتقال، إننا لسنا راضين عن الطريقة التي يناقش بها المالك بعض البنود الصغيرة.
إنها ليست بنود رئيسية من شأنها أن تسمح لنا بإنهاء العقد قانونيًا ولكنها تفاصيل صغيرة لا تمنحنا الثقة في أن حياتنا ستكون سهلة معهم في المستقبل.
لذلك، نريد إنهاء عقد الإيجار هذا الذي سيكون ساريًا بدايةً من الأول من نوفمبر.
السؤال هو؛ ماذا ستكون العواقب المترتبة على هذا الإنهاء؟ بالنظر إلى أن العقد لم يبدأ بعد، هل يمكننا إنهاؤه الآن دون دفع أي غرامة واسترداد وديعتنا؟

س: لقد استأجرت شقة في إمارة دبي من خلال شركة عقارات خاصة منذ عام 2016. لديّ شهادة تسجيل عقد "إيجاري" والتي تشير إلى أن مساحة الشقة تبلغ حوالي 800 متر مربع، لكنها في الواقع تبلغ حوالي 400 متر مربع.
هل يحق لي اتخاذ أي إجراء ضد الشركة العقارية؟

مطالبة المستأجر بغرامة لتجاوز المدة في حالة إنهاء الإيجار دون إشعار

س: عزيزي السيد مال الله،
أريد معرفة رأيك في موقف أتعرض له في الوقت الحالي مع مالك العقار السابق.
بعد الإقامة في نفس الشقة لمدة أربع سنوات بصفتي مستأجر، في 08/02/2021، قبل أسبوع فقط من موعد التجديد (15/02/2021) وبعد الحصول على اتفاق مكتوب يتضمن البنود المتفق عليها بشكل متبادل وبعد إرسال العقد لنا، أخبرنا المالك أنه غير رأيه وأنه سيطبق بنود العقد القديمة.
بعد تبادل رسائل البريد الإلكتروني مع وكالة المالك، تلقينا في 23/02/2021 البريد الإلكتروني النهائي من الوكالة بشأن قرار المالك. وبما أنني لم أرغب في البقاء في عقاره، خرجنا يوم 06/03/2021.
في 14/03/2021، تلقينا عرض أسعار من الوكالة بخصوص الصيانة، ولقد وافقنا عليه في 15/03/2021.
ولكن منذ يومين، حيث كنت في انتظار وديعة التأمين الخاصة بي، تلقيت حسابًا نهائيًا من الوكالة حيث يطلبون مني الدفع مقابل تجاوز مدة الإقامة في الفترة من 15/02 وحتى 05/03. لقد ذكرناه عدة مرات بالقواعد واللوائح لكنه لا يبالي.

Q: My Real Estate agent has included annual gas consumption charges in the contract and forced us to pay, even though we don't have a connection.
I don't use gas and don't need one (Using an Electric cooker and having food delivery service from outside).
Let us know whether it is legal? And what options do we have?

Can my community deny access to parking and facilities if I signed a tenancy contract but no Ejari?

Q: Good afternoon,
Hope you are all in good health!
I'm renting a property in a community, and this is my second year. I have a tenancy contract signed by both the landlord and me; however, Ejari will take some time to be processed.
I understand that, as per the community rules, access cards for community facilities (such as the pool, gym, etc.), along with the parking access card, will be deactivated until I get Ejari. However, is this legal?
Since I have paid the rent and have a signed tenancy contract, can they do this?
My questions:
1. Does the community have the right to deny me access to parking and facilities if I have a valid tenancy contract but no Ejari?
2. If they have the right, then that's okay. But if they don't, what should I do if they stop me from using my parking space?
3. Should I call the police if security denies me access to parking?

Hello,
My employer fired me under Article 44 for not showing up for work for 7 days in a row. But that’s not the case at all. I was sick and the management was aware and they let me go.
I went to another country to get treatment because it’s expensive in Dubai. My employer did not pay me my salary for the month I worked and fired me.
I have official sick leave from another country and there is correspondence where my employer sent me to another country for treatment.
The problem is that the employer says that he will take compensation for the training that was specified in the contract, but I did not undergo training at all; I immediately started work from the first day of work and there was no training.
Does my employer have the right to charge me such a fee and not pay my salary?

How to cancel the MoU to buy an apartment with the broker if the bank did not approve the loan? 0
Hi,
I have a situation where I signed an MoU and gave my security deposit to the seller's agent. However later, the bank valuation of the property is lower than the selling price.
On my MoU, it has a clause that “the buyer has a right to cancel/negotiate if the bank valuation is not the same as MoU.” I tried to negotiate, however, we didn't agree on the price so I asked to cancel.
Now the agent is threatening me that they will not cancel the MoU and that will deposit my cheque. Later I also came to know that the person I am dealing with is not the same person whose name is mentioned as a broker in the MoU.
The agent I am dealing with is constantly messaging me with threats. I decided not to speak to him and instead, I wrote an email to the broker whose name is mentioned on the MoU but received no response.
I am on a very tight timeline as I need to vacate my apartment in 3 weeks, I found another unit but I don't know if I can pursue this while the initial MoU still not canceled.
Please, I need advice.
