كيف يمكن الحصول على التسوية بعد صدور الحكم النهائي؟
س: سيدي العزيز / سيدتي العزيزة،
لديّ قضية عمالية وصدر الحكم النهائي لصالحي. لم تتم التسوية حتى الآن. لقد فتحت ملف تنفيذ من خلال مركز الطباعة.
وفقًا للوزارة، لقد تم إلغاء تأشيرتي وتصريح العمل الخاص بي بعد صدور الحكم. أحتاج إلى مشورتك حيث أنني لا أعرف الإجراءات الإضافية الواجب اتخاذها والمدة التي يجب أن أنتظرها للحصول على التسوية. أنا الآن في فترة سماح وستنتهي الأسبوع المقبل.
لقد طلبوا مني في مركز الطباعة التواصل مع مركز تبليغ للحصول على إشعار. لا أعرف ما هي الإجراءات المتبعة. كم من الوقت يجب أن أنتظر للحصول على التسوية؟
أعلم أنه سيتم فرض غرامات عليّ بسبب تجاوز مدة الإقامة المحددة. هل أحتاج إلى الخروج من البلاد أو تجديد تأشيرتي؟ أنا عاطل عن العمل في الوقت الحالي. لماذا يطلبون مني التواصل مع مركز تبليغ؟
لماذا تأخرت التسوية على الرغم من أنه تم صدور الحكم بالفعل؟ لا تزال الشركة مفتوحة. يمكنهم دفع التسوية المستحقة لي. لمن أتوجه لمساعدتي في الحصول على التسوية في أسرع وقت ممكن؟ أتمنى أن تقدموا لي إجابات صحيحة لمساعدتي في حل هذه المشكلة.

كيف يمكن إقناع قاضي التنفيذ بفرض منع من السفر على مدير الشركة؟
س: هل يمكن فرض منع من السفر على مدير شركة مَديّنة في قضية تنفيذ مدنية؟
لقد طلبت فرض منع من السفر على مدير الشركة.
رفض القاضي ذلك لأن هوية المدير غير محددة في الترخيص التجاري (لكنه مذكور في عقد تأسيس الشركة وبعض الأحكام النهائية الصادرة عن المحكمة).
بعد ذلك قدمت تظلم ضد حكم التنفيذ.
لكن حكم التظلم ينص على أنه لا يمكنني ملاحقة المدير للدفع ما لم أثبت أنه ارتكب خطأ أو احتيال أو خداع من قبل المدير.
وبناءً عليه، هل لا يزال من الممكن فرض منع من السفر أو إلقاء القبض على مدير الشركة بسبب تخلف الشركة عن السداد حتى بدون إثبات أي خطأ أو احتيال أو خداع ارتكبه المدير؟
وذلك وفقًا للمادة 186 من قرار مجلس الوزراء رقم 57 بشأن اللائحة التنفيذية للقانون الاتحادي رقم (11) لسنة 1992 بشأن قانون الإجراءات المدنية. يسمح القانون بالمنع من السفر أو إلقاء القبض على أي ممثل قانوني.

كيف يمكن مطالبة شركة مدنية بالديون المستحقة بعد فتح ملف التنفيذ؟
س: لقد ربحت قضية مدنية ضد شركة مدنية تمتلك ترخيصًا مهنيًا (وليس شركة ذات مسؤولية محدودة). فتحت ملف التنفيذ بقيمة 262,800 درهم.
أبلغني أحد الشركاء في الشركة المدنية بأن شركته ستقوم بتقديم طلب لإشهار إفلاسها وأنني لن أحصل على أي أموال على الإطلاق.
وأخبرني أن جميع ديون الشركة سيتم محوها ولن يتم معاقبتهم ولن يضطر لدفع أي شيء.
تنص المادة (671) من قانون المعاملات المدنية بشأن الشركات المدنية على أن الشركاء يجب عليهم سداد ديون الشركة.
(أ) ما هو الرأي القانوني الصحيح؟ هل يمكنني المطالبة بالأموال مباشرةً من الشركاء في الشركة المدنية بعد إعلان إفلاس الشركة؟
(ب) كيف يمكنني حماية حقوقي في حالة قيام الشركة المدنية المَديّنة بتقديم طلب لإشهار إفلاسها؟
(سؤال هام: ج) هل ستوزع المحكمة تلقائيًا ديون الشركة المدنية على شركائها في حالة إشهار الإفلاس؟ أم يجب عليّ رفع قضية جديدة ضد الشركاء بعد إشهار إفلاس الشركة المدنية؟

The defendant hasn't paid despite the court order. How to recover my money?
Q: Dear Sir/Madam,
As the plaintiff, I filed a case in Dubai Courts through AL ADHEED regarding a bounced cheque. The court issued an order instructing the defendant to clear the payment by December 25, 2023.
However, the defendant has not honored the judgment, and the payment remains unpaid.I received advice from the representative at AL ADHEED that my next step could be to request the blockage of their trade license.
However, I am unsure if this action will assist me in recovering my money.
Can you please advise on the appropriate next step for me to take in order to recover the money?

Can the new owner of an apartment increase my rent if it is against RERA Index?

I'm a tenant of an apartment and a new owner has purchased the apartment. I would like to know:
1. Should I revise the Ejari by canceling the previous one and applying for a new one?
2. My current rent is 35% less than the current market value. Can the new owner change the rent as per the market value, or he still has to follow the RERA Index calculator for a new contract?

I agreed with my landlord to increase the rent 10% I pay in cash. Should I insist on changing the contract?
I'm staying in JLT in a house with a rent of AED 140,000 per year. The lease starts on 1st Sep '23 and expires on 31st Aug '24.
The landlord sent me a legal notice from the Dubai Courts in mid-Sep '23, giving me 1-year notice to vacate the house as he plans to sell the house. The notice was received by me through email from the court.
He claims the email notice sent by the court is not valid till I receive it by courier via Aramex for my physical signature. Can you please confirm if this is true?
The landlord is now ready to let me stay in this house for two more years. He has proposed that we maintain the existing lease agreement and Ejari. However, I should pay him AED 14,000 in cash (10% increment).
We will sign a separate paper document wherein we will agree that I will further rent increase of 10% (10% on (140,000+14,000)) on 1st Sep'24 when my current lease expires.
Should I insist on making a fresh written contract with the higher rent (140,000+14,000=154,000)?

I have signed Form F and got the mortgage but the seller is in breach. What to do?
Hi
I have signed the MOU Form F since July 2023 and we prepared all the papers and the loan from my end on 23/8/2023.
When I went to DLD for the transfer, the seller had registration issues and asked for some papers to be provided as the property is under the company not an individual.
Since that time, we have kept renewing the MOU every month in the hope of finalizing but I am not seeing any progress.
So I am asking about legal action as I already got a bank mortgage and started paying as well but not seeing any progress from the seller.
So I need to ask the following:
1. If my MOU expired on 20.11.2023, can I file a complaint on 20 or after a couple of days like 23?
2. What will happen in terms of 10%? Will it be returned and what about the fees paid to the bank like mortgage fees, evaluation, and cancellation of loan? Will the EMI payment be compensated by the seller?
3. What is your advice?
