Q: Dear Sir/Madam,
Warm greetings from Ukraine.
Our company provided services to UAE company last year according to partnership agreement that was signed by both parties. However we didn't receive payment till now.
Company representatives are not providing any specific information regarding terms of payment and we are not sure they will pay at all.
Would you be so kind to advise the best and cheapest legal way in order to resolve payment issue?

What can be done if your customer is not paying your invoices?
Q: My firm (based in the UK) is owed $57,500 for providing materials and event management services for a Dubai-based business called International Premier Tennis League.
They have failed to pay my invoice or any of the individual skilled craftsmen and technicians I recommended they hired to deliver the events which we delivered in December 2016.
What I'd like to do is recover my money and possibly make sure that the business behaviour of the IPTL management team is not repeated (it must be a crime to commit business services to a project without ever having the means to pay for it).
Any help or advice appreciated, please.

What can be done if your customer is not paying your invoices? (Part II)
Q: Dear Sir/Madam,
I worked as a broadcast and event management consultant and ran large scale sports entertainment events for a UAE based client but my invoice for labour and material expenses remain unpaid after six months.
My client claims they are restructuring and are hoping to pay me but what can I do to help recover my money? I am UK based.

Refusal to pay for the job done
Q: We are a software company who have signed a contract with a client. The contract expired in Nov. 2015. We continued to work with the client on the project. We received 5 payments out of 7 payments that were due. Each payment was linked to a milestone in the project. Now the client claims the software solution is not up to the quality they want and they want to sue us for damages.
In the contract, we have a clause that says they can sue for a maximum of 50% of the money they paid us. However, each of the 5 payments they made were linked to a milestone of the project contract and the payments that were made were approved by their managers who now claim that the software quality has an issue.
Are they entitled to sue for damages? How can we best protect ourselves?

تم قبول استقالتي في 15 نوفمبر 2017 وطُلب مني تسليم المسؤوليات إلى الإدارة الجديدة منذ أكثر من عام مضى. تم إلغاء تأشيرتي أيضًا في أغسطس 2018 بعد بضعة أشهر من استقالتي.
تولت الإدارة الجديدة المسؤولية ولم تتمكن من إدارة الأعمال بكفاءة بعد مغادرتي، وأدى ذلك إلى إنهاء خدمة الإدارة الجديدة.
تقوم الشركة الآن بإلقاء اللوم علي خلال فترة توليتي للمسؤولية مع الشركة في السابق، كانت هناك بعض القرارات الخاطئة التي تسببت في خسائر للشركة.
تريد الشركة الآن رفع دعوى قضائية ضدي. أنا أتلقى رسائل تهديد عدة واتصالات لكي أعود وأحل القضايا القديمة، وهذا يسبب لي العذاب المعنوي.
أنا لست في وضع يتيح لي مساعدة الشركة في التعافي من خسائرها. يرجى تقديم المشورة ماذا يفيد قانون العمل في الإمارات العربية المتحدة في مثل هذا الوضع؟

My Dubai tenant's rental agreement is ending by the end of September 2024 and the completion of 12 months of legally served Eviction Notice is the end of December 2024.
I have two questions:
(a) Can I send a rent increase notice 3 months before as the rent has increased as per the RERA rent calculator?
(b) The second question is, do I have to renew the rental agreement for 3 months (until December 2024) or not?

كيف يمكنني التوصل إلى تسوية مع البنك بشأن رهن عقار مشترك؟
لدي عقار مشترك في أبوظبي. لقد تعثرت في سداد الرهن العقاري حيث اضطررت إلى مغادرة العقار مع أطفالي بعد اعتداء زوجي السابق. غادر البلاد في عام 2018 ولم يدفع الرهن العقاري أبدًا.
بما أنني كنت في البلاد، رفع البنك ضدي قضية جنائية، وحكم عليّ بالسجن لمدة 3 سنوات. لقد فزت بالاستئناف ضد البنك ثم رفع قضية جنائية أخرى بعد بضعة أشهر في دبي. مرة أخرى، فزت ودفعت غرامة.
في عام 2019، رفع البنك قضية مدنية ضدي وضد زوجي السابق لاستعادة الممتلكات. ومع ذلك، في وقت شراء العقار، لم تكن هناك سندات ملكية، ويطلب البنك ذلك.
لا أستطيع أن أعطيهم سندات الملكية لبيع العقار وسداد المبلغ المستحق لهم لأن زوجي السابق يرفض تقديم توكيل. لقد رفع البنك قضية جنائية أخرى ضدي فقط فيما يتعلق بممتلكاتنا المشتركة.
أرغب في حل هذه المشكلة وسداد مستحقات البنك واستلام أي أموال متبقية من البيع. كيف يمكنني حل مشكلة سندات الملكية؟

فشل صاحب العمل السابق في دفع مكافأة نهاية الخدمة الخاصة بي منذ ستة أشهر منذ استقالتي، هل من الممكن رفع قضية ضده بعد مدة 6 أشهر؟

هل يحق لوكالة العقارات الاحتفاظ بنسبة من بيع العقار حتى نقل الملكية؟
وقّعت وكالة العقارات على مذكرة تفاهم تنص على أن وديعة التأمين بنسبة 10٪ المقدمة من المشتري والبائع سيتم الاحتفاظ بها لدى الشركة وسيتم تحريرها عند نقل الملكية.
ولكن تم حظر نقل الملكية بأمر من المحكمة.
وفقًا لزملائي، وكالة العقارات ليست وصيًا ولا يحق لهم الاحتفاظ بشيك الضمان الخاص بي من الأساس، فهل هذا الأمر صحيحًا؟
