Employee rights in case of changing an unlimited contract to a limited contract

Hi,

What is the law if an employer wants to change a contract from an unlimited to a limited contract?

Is the employer liable to pay the 3 months arbitrary dismissal (if valid) + other monies owed prior to changing the current unlimited contract to a limited contract?

Dear questioner,

If the employer wants to change the contract, both parties have to agree to the changed terms.

Also, note that on the expiry of the limited contract, the employer may terminate you without any compensation.

Is the employer liable to pay the 3 months arbitrary dismissal (if valid)?

If agreed, then yes, but they cannot force you to change the contract.

Any other monies deserved prior to changing the current unlimited contract to a limited contract, you can get it paid now.

Thank you for your response.

As I understand from what you have said, the contract change (from unlimited to limited) needs to be agreed by both parties?

Does this mean that the employer cannot just give notice for change of contract (from unlimited to limited) and then implement that change?

Yes, he cannot give notice as he does not have the right to change the contract without your signature.

You may stay silent - depending on the circumstances - and later you can advise him that this is invalid as per the law.
