س: لدي عقد عمل غير محدد المدة مع شركة، لكنني لم أكمل فترة الاختبار هل يمكنني ترك الشركة دون إخطارها أم يجب على إخطارها مسبقًا؟ وهل يمكن للشركة حظري من العمل أم لا؟

Q: Hello Ma'am, I just want to ask for advice, as my employer just recently terminated me under a limited contract. I was hired July 2, 2017, and last Wednesday, Sept 20, 2017, the newly hired HR and General Manager spoke with me that they will no more continue my contract with them. They are claiming that I have made delays which I'm not aware of, and they didn't send me any warnings through email. I have filed one-day sick leave when I was not really feeling well. Immediately on that day, they gave me a cheque which I served for 20 days only. They just told me without any notice period, and haven't informed me or warned me if I have committed mistakes with their policies. Is this right? Thanks in advance.

س: أعمل لدى شركة بعقد غير محدد المدة وهذا هو الشهر الثالث لي في هذه الوظيفة، وسؤالي هو إذا قررت الشركة إنهاء عقدي لأن آدائي لا يرقى إلى المستوى المطلوب مثلًا، فهل عليّ رد ثمن التأشيرة  وتذكرة الطيران والتدريب للشركة؟ مع العلم أنه خلال عملية التوظيف، جعلتني الشركة أوقع على إقرار بأنني إذا تركت العمل قبل 3 سنوات، سوف يتوجب عليّ رد ثمن التأشيرة وتذكرة الطيران والتدريب. أحتاج لنصيحتك.

Q: Dear Madam, I have an unlimited contract with the employer and I have not completed the 6-month probation period. The company gave me a termination letter without any warning letter before. 1. If I get a job in some other company, will I get a labour ban or not? Some people told me even if you have an unlimited contract, but your company terminated you under probation period. I must have completed 1 year to avoid the ban. Please advise me, what do I do? 2. The company gave me termination letter one day before my completion of the 6-month probation period. My question is that I joined the company on 27 August 2017 and the company gave me the termination letter on 26 February 2018, but if I count the days then it is 184 days, while 6 month means 180 days. Please advise? 3. If 184 days are considered 6 months what are my rights? Can I demand the company to pay my settlement, air tickets and half year leave salary... etc? The HR told me that under probation, the company do not pay me any benefits like back home tickets, gratuity...etc.

س: التحقت للعمل بشركة في أبو ظبي قبل ثلاثة أشهر. بسبب بعض المشاكل في الحصة المخصصة، أعطوني تأشيرة ساعٍ على جواز سفري. ليس لديهم مشروع الآن ويريدونني البحث عن وظيفة أخرى أو أنهم سوف يلغون تأشيرتي. إن عقدي هو عقد محدد المدة والتأشيرة هي تأشيرة ساعٍ. السؤال هو إذا كانوا سوف يلغيون تأشيرتي، فهل سيكون هناك حرمان من العمل؟

أقرت دولة الإمارات إصلاحات تشريعية كبيرة أسفرت عن إدخال 40 قانونًا وتعديلًا جديدًا على قانون الشركات والقانون الجنائي وقانون الأحوال الشخصية وغيرها. تهدف هذه التعديلات إلى تطوير الهيكل التشريعي في مختلف القطاعات، وكان أحدثها قانون العمل. نحاول في هذا المقال إلقاء الضوء على التعديلات التي أُدخلت على قانون العمل الجديد وتأثيرها على كلٍ من صاحب العمل والعامل.

The provisions of this Law, known as "UAE Labour Law", govern the relationship between employers and employees and other labour matters in the United Arab Emirates. There are special labour related regulations applicable in some of the free zones in the UAE.

This Decree sets the rules and conditions for the termination of fixed-term (limited) or unlimited (not term-bound) employment contract between employer and worker in the United Arab Emirates.

By this Decree Ministry of Labour of the UAE has removed the six-month labour ban for those who changed the job before completing two years of service. Labour ban will be still applicable for workers that qualify for skill level 4 and 5 under various circumstances.

The provisions of this Decree-Law, known as "New UAE Labor Law", govern labour relations in the private sector of the United Arab Emirates. The New Labor Law repeals the previous UAE Labor Law (Federal Law No. (8) of 1980).
