Can post-dated cheques be revoked?

My husband is selling icecreams in a cafe in Dubai. He has started a business from this. He needed a visa and the owner gave him a visa but we paid for it. The owner wrote a contract by email but we haven't signed it. We have given 3 cheques for the next year and are paying quarterly.

Unfortunately, the business/icecreams are not selling at all and we want to get out of the contract. I would like to know what hope do we have to get out of the contract as we haven't signed it but he has the year cheques on him.

You have to approach the owner requesting him to return the cheque. A cheque is enough to show a debt and need not be supported by any agreement.

When the cheque is returned as unpaid for any reason whatsoever, the aggrieved party/beneficiary of the cheque(s) files a complaint with the Public Prosecution or any authorized officer at police stations against the signatory of the dishonoured cheque.

It means a cheque must be honoured. If you gave it means you owe the payment. It does not require an agreement to be signed.

Please approach the owner to accept your request to return the balance cheque.

But you said the cheque is like an agreement which seems to me like it's a bound agreement? So you are saying that we could get out of this?

When I said a cheque is an agreement it means you have to fulfil your obligation ie to honour it. An agreement is made to do something in return for something.

The only way to get out is to talk to the owner and explain your problem. If he does not listen to you then borrow and see to that the cheque does not bounce.

This is the contract that we did not sign:

"...the restaurant will provide the space for the ice cream vending machine inside the restaurant at ...... on rent.
2. The tenant will pay 48000 rent in 4 cheques for one year.
3. The contract is valid for one year and can be renewed at the end mutually.
4. The contract starts from 1st October 2017.
5. All the ice cream ingredients and machine repair will be taken care by the tenants.
6. The landlord will give a space for the machine and the billing support.
7. The machine will be handled and sales will be done by the tenant.
8. The tenant will not intrude in daily sales of the restaurant and will abide with restaurant timings and rules.
9. The electricity bill will be paid on a monthly basis, lumpsum of AED 100."
