Claiming benefits from employer according to the last salary paid

Dear Sir,

I want to ask a question.

I am currently working in a small workshop that includes 10 workers. My employer made my salary in the labour contract AED 700 per month, but after one year I got a driving license and he increased my salary to AED 2000.

Now I have no proof that he increased my salary, but I have salary card that mentions AED 2000. If I file a case in the labour court that he did not give me my salary for the last 4 months, then which salary does the court count, 700 or 2000?

You will be paid based on the last salary received, even if the contract does not say so.

1) Since the employee resigned instead of getting 21 days' Remuneration for each year of the first 5 years of service (ARTICLE 132) he will be entitled to one-third of the severance pay provided for in the preceding article (ARTICLE 137).

2) Leave - Employee is entitled to 30 days since he has worked for more than one year - ARTICLE 75.

3) Air ticket only if the employee is going back home and not going to join a new employer or does not have the means to pay- ARTICLE 131.

4) Notice period - 30 days, (Salary as per the last wage received) - ARTICLE 117.

5) Pending salary and commission as agreed.
