How can I make an offer and deposit for a returned rental cheque?

My cheque has been returned. RDC informed me that I can make an offer and deposit for the returned cheque.

Does anyone know how this works?

They said it is different from the offer and deposit you do prior to renewal, where you wait 5 days.

With this type of offer and deposit, you can hand over the cheque to RDC.

Please advise.

When a cheque bounces in an RDC tenancy matter, the system allows you to use Offer & Deposit in a different way than the standard pre-renewal process.

Here, you, as the tenant/landlord, can directly deposit the returned cheque with RDC so that the other party is formally notified and given the chance to collect it.

Unlike the renewal Offer & Deposit (where the 5-day waiting rule applies before it is considered effective), in this situation, the cheque itself is lodged with the RDC and serves as proof of your readiness to settle.

This mechanism protects you legally, as you can demonstrate that you offered the payment properly, even though the cheque was initially returned.

In practice, you submit the bounced cheque to the RDC cashier together with your application for Offer & Deposit. RDC records it, notifies the other party, and holds the cheque for them. This avoids any claim that you failed to pay.

I strongly recommend we handle this carefully because a bounced cheque can also trigger separate execution proceedings if not regularized.

I can assist you in preparing the Offer & Deposit application and make sure it is submitted correctly to protect your rights and avoid unnecessary penalties.

You can reach me directly on WhatsApp or by phone, and we can discuss your tenancy papers and cheque situation in detail.

Is this applicable to an irregular signature as well?

What if I want to pay cash instead, and will it protect me against eviction?

Dear Inquirer,

In the case of a returned cheque, the RDC does provide an option for an “offer and deposit,” which differs from the process done before lease renewal.

This procedure allows you to submit the cheque directly through the RDC system, but the legal implications and next steps depend on the details of your case.

For tailored guidance and to protect your rights, we recommend booking a consultation or appointing our office, Future Vision for Advocacy and Legal Consultancy, to act on your behalf.

Best regards.

When checks are returned, the Rental Disputes Center (RDC) can submit a bid and deposit to return uncashed checks through the Department of Land and Property's bid and deposit service, which delivers the returned checks to the RDC.

This differs from the bid and deposit process conducted prior to renewal, which requires a five-day waiting period, as the checks are delivered to the RDC immediately.

Dear Questioner,

Thank you for your message.

In the UAE, when a cheque is returned, the RDC allows you to make an Offer and Deposit to resolve the matter.

This process is different from the standard Offer and Deposit done prior to rental renewal, which typically involves a 5-day waiting period.

For a returned cheque:

You can hand over the cheque or its equivalent amount directly to the RDC.

This shows your commitment to settling the matter and can prevent immediate legal escalation.

RDC will hold the deposit and communicate with the landlord, and once accepted, this may resolve the issue without court involvement.

Please ensure you retain the RDC receipt for your records. If the landlord does not accept the settlement, legal action may still proceed.

We can guide you through the exact steps and assist in submitting the deposit properly if you wish.

Best regards,

Hello,

Regarding the RDC offer and deposit for a returned cheque, it is different from the usual offer prior to tenancy renewal.

You hand over the bounced cheque and the bank return memo to RDC along with your offer and deposit application.

RDC treats the cheque as an execution document, so they don’t require the usual 5-day wait. If the debtor doesn’t pay within the specified period, RDC can initiate enforcement actions.

Let me know if you need help preparing your documents or filing this with RDC.

Thanks.

I have the cheque memo; however, the original cheque is with the landlord, and he won't return it

Dear questioner

The process you are describing for a bounced cheque is a specific and urgent procedure.

The RDC is correctly guiding you to put an offer and deposit in a manner of "Execution" case to offer and deposit the funds, which allows you to hand over the money to them immediately and receive a receipt that protects you from further legal repercussions.

It's a faster, more direct process because the evidence (the bounced cheque memo) is clear.

If you need more clarification, kindly share your WhatsApp number.

Thanks a lot for your response.

Is this applicable to an irregular signature as well?

Also, can I give cash to RDC instead of another cheque, as I'm worried about the signature issue?

Or I can give a manager's cheque?

17 Sep 2025, 05:53

Yes, the RDC's official guidelines for the "Offer and Deposit" process for a bounced cheque explicitly state that you can pay in cash or by a manager's cheque.

This is the safest way to ensure the payment is accepted and to avoid any further issues with your personal cheques.

Dear Client,

Yes, as per the details you have shared, this is a specific RDC “Offer & Deposit” used after a rent cheque bounces.

You file it with the Rental Disputes Center and deposit the due amount with RDC (often cash for past-due, cheques for upcoming periods).

Once accepted by the judge, you’re treated as paid from the acceptance date, and RDC handles releasing the funds/cheque to the landlord.

It’s different from the pre-renewal O&D (where you deposit cheques and wait for the notice period).

For the exact steps, required documents, and filing sequence for your case, please contact our office.

Kind regards,

Althea & Jacobs

Hello,

Under UAE Federal Decree-Law No. 50 of 2022 (Commercial Transactions Law), a returned cheque - particularly due to insufficient funds - can now be treated as an executive instrument, allowing the beneficiary to proceed directly with enforcement without initiating a full civil case.

However, certain RDCs may offer an alternative route known as “offer and deposit,” which allows you, as the drawer, to submit a formal offer to settle the outstanding amount along with a deposit, potentially deferring enforcement action and facilitating resolution.

This procedure differs from the offer and deposit mechanism used prior to lease renewal (which involves a 5-day waiting period).

In the post-cheque-return scenario, the RDC may allow you to submit a new cheque or payment directly to them as part of the settlement process.

It is crucial to obtain written confirmation of the terms, deadlines, and legal implications of this arrangement.

We recommend carefully reviewing the RDC’s specific procedural rules, ensuring the deposit is properly recorded, and confirming that your legal rights remain protected throughout.

Should you wish, we can assist in reviewing or drafting the necessary documentation to formalize this process and ensure full compliance with current UAE laws.

Kind regards,
