صحة اختصام الشريك في شركة تضامن رغم عدم عمله بها
س: يعطيكم ألف عافية! أنا كنت مسجل مع أخي كشريك بشركة تضامن بنسبة 1% ولم أكن أعمل بنفس شركة أخي؛ كنت أعمل بشركة أخرى وعندي إثبات بذلك من الضمان الاجتماعي. رفع صاحب البناية دعوى على أخي بعدم دفع الإيجار وترتب على ذلك 77 ألف دينار مع الفائدة. رفعت دعوى بالمحكمة من 4 شهور تقريبًا بمنع مطالبة ومعي إثبات اتفاقية صورية من أخي. ليس لدي حقوق بالشركة ولم أوقع على عقد الإيجار. كان أخي هو المفوَّض بكل شي. سؤالي: ماذا يترتب عليّ؟ وهل الدعوى التي رفعتها بالمحكمة إجراء صحيح؟ كل الشكر! إبطال تعميم مبني على قضية جائرة بدعوى عدم دفع إيجار الشقة
س: القضية مرفوعة من سنة ٢٠١١ وهي كالتالي: استأجر زوجي شقة للسكن عند شخص بدون عقد سنوي، وابنه كان موكل بجمع الإيجارات. وبعد سنة، قرروا بيع العقار ورفضوا استلام الإيجار لكي يرفعوا قضية إخلاء. توجهنا للدفع عن طريق المحكمة، وبعدها بفترة بسيطة تم بيع العقار وكتابة عقد مع المالك الجديد. فوجئنا سنة ٢٠١٩ برفعهم قضية عدم دفع الإيجار بقيمة ٥٠٠ دينار وغرامات تصل إلى ١٢٠٠ دينار ولم نُبلَّغ بأي قضية خلال كل هذه السنوات وموجود تعميم بالمحكمة. حاليًا هو خارج الأردن ولا يستطيع العودة بسبب هذا التعميم. ما الإجراء القانوني لمثل هذه الحالة لأنه ظلم كبير؟ الرجاء المساعدة بأسرع وقت! Acting against delay of delivery for a purchased property
Q: Hi, My house was supposed to be delivered on 30 Dec 2018 but it`s more than 1 year of delay and still, there is no communication on when it will be delivered. I have paid 30% of my house value in October 2018 + 2% DLD and rest 70% is on delivery as per the agreed payment plan.
