Q: Good afternoon. I am on an unlimited contract in Abu Dhabi, working at a private company. I`ve been here for 5 months, now I submitted my resignation letter to my boss last May 18 as he wanted to put me on commission-based payment. I asked for a reduction of salary letter or any letter stating that I will be on a commission basis. He doesn`t want to give me and wants me to reimburse the money he has put in my bank account. He wants me to pay for the visa costs. He is also holding my passport. I have filed a complaint on MOHRE about this on May 18. Then he received a message about the complaint and instructed me to leave. On May 19, I received a call from MOHRE and we settled and I withdrew the complaint. I went back to work to do the 1-month notice but he refused. He is threatening me that I was absent since May 18. He doesn`t want me to work there, he deleted my work email. I was at the office on May 22 but he refused to accept me so I called MOHRE about my case and they reactivate my complaint again.

I believe the security cheque has been deposited due to non-payment from my side and a criminal case filed against me, which I am not sure about. Q: Hello. My husband is a heavy truck driver in a transport company in Dubai, working in that company for the last 4 years. His boss (arbab) suddenly asked them to work on less salary of just AED 2500. My husband and his other 3-4 colleagues were not willing, so their boss started harassing them. He didn`t pay their money, made them sit free at home for many months, neither was he canceling them. So they took legal help and filed a case against him in the labor court. In turn, that boss filed a criminal case against my husband and his colleagues, a false case that they have made a loss to his company by stealing and selling diesel illegally. He has got a confession letter signed by them by lying. he told them as papers for attending safety classes. He didn`t allow them to see the papers. The papers were in English which they don`t understand being not much educated. He has put a loss claim of approx.1 lakh dhs on each of the 4 persons. What are our chances in this situation?

What happens when the bank threatens with a civil case for outstanding loan?

Q: Hi I have a loan with a bank amounting to AED 165,000 but due to redundancy, I lost my job and was not able to pay the installment. When I got the gratuity, the bank deducted the amount of AED 51,000 at once from the total outstanding. Today, almost three months have passed, and now they are threatening me to file a civil case for the remaining amount of AED 112,000. Can you please guide me on what actions they can take? In case of a civil case, how much fine I need to pay? And for the mentioned amount, do I have to face a jail term?

Closing an account after paying the complete loan upon buying a company

Q: I had purchased a company from someone and had taken his personal loan on my shoulder but when I realized that there are a lot of other depths such as company cheques, I asked the old owner to return my payment. He agreed to pay half and asked me to sell the company under another person`s name. The 3rd person who took the company from me had agreed that he will take the personal loan to his shoulder but after taking the company, he didn’t approach the bank to change the signatory and he run away because the company bank account still under my name (only as per bank record) but legally, the company is not under my name at all. To avoid issues, I keep paying my monthly installment which is above 6500 AED directly to the loan agreement number. I can see that the court has blocked my x- company account and informed the bank to deduct above 320k in case it is credited from other sources to that account. My question is should I complete the loan? If yes, after completing the loan, can I close the account by showing the new memorandum?

After a couple of weeks, he changed his mind and didn`t want to move out and didn`t accept the increase saying that it is now less than 90 days to the end of the contract and I didn`t send him notice through a notary. If I file a case at RDC, who pays for all the RDC fees and lawyer fees? Does he have to pay for RDC fees and my lawyer fees as I have to pay RDC fees first in order for the process to start?

Q: Hi I want to know how to file a criminal case against my ex-husband. He was physically abusive and there were 2 incidents where I ended up in the hospital, and along with a medical report, the matter was taken to the police station. Both times he was summoned and he was made to sign warning letters by the police. There was no case filed though. I want to know if I can file a case now based on those 2 incidents since they must be in the police record.
