تعذر تنفيذ حكم عمالي بسبب هروب أحد المديرين ورفض المحكمة الضبط والإحضار
س: السلام عليكم، أنا عامل لدي ملف تنفيذي مفتوح. الشركة مدينة بمبلغ يتجاوز 155 مليون درهم ومديرها الشريك هرب للهند (وتقريبًا يشغل أموالنا في الهند حاليًا)، وفيها شريك مواطن و2 مدراء عاديين. قدمت منع سفر رُفض، وقدمت ضبط وإحضار 4 مرات وأحضرت مستندات أن الشركة تدفع الرواتب حاليًا وتعمل بحسابات بنكية شخصية، القاضي قال: "شركة ذات مسؤولية محدودة لها شخصية قانونية مستقلة عن شخصية المدير المطلوب ضبطه وإحضاره". سألت محامي قال هناك توجيهات عليا بتجنب الضبط والإحضار. إذًا لا منع سفر ولا ضبط ولا أموال؛ كأن القاضي يقول لي تعيش وتشوف غيرها. حصلت على نسخة من رخص تجارية لشركات أخرى الشريك الهارب شريك فيها وفلل تملُّك شخصي. هل يجوز التنفيذ عليها؟ وهل يمكن استدعاء الشريك المواطن للسؤال؟ Questions & Answers

The validity of an eviction notice when the apartment is sold
Q: Hi Maryam, I am a tenant in Dubai. My previous landlord served me an eviction notice of 12 months on the premise of moving in through a notary, and now he sold the apartment to a new landlord. Is the eviction notice still valid? Or does the new owner have to send me a new one? Many thanks!

دفع الإيجار المتأخر في حالة الفوز بدعوى عدم زيادة الإيجار
س: السلام عليكم، كنت أجدد عقد الإيجار ووجدت أن مكتب العقارات يريدني أن أدفع زيادة في الإيجار 10 آلاف درهم. ذهبت إلى مركز فض المنازعات الإيجارية وأخبرتهم بذلك وقالوا لي ليس لهم الحق في زيادة الإيجار وتقدمت بطلب عرض وإيداع لكن مكتب العقارات لم يستجب. ذهبت إلى مركز فض المنازعات مجددًا وقالوا لي ستبدأ بسداد الإيجار عندما يقبلون العرض. بعد خمسة أشهر تحدث مكتب العقارات معي ويريدني أن أذهب لتجديد العقد لكنهم يريدون أن أدفع الزيادة. ذهبت إلى مركز فض المنازعات وتم تحديد جلسة تقاضي وكسبت الدعوى ولدي الحق في تجديد عقد الإيجار بنفس القيمة الإيجارية في العقد السابق. هل يجب أن أدفع الأشهر الماضية؟ وما الحل؟ Questions & Answers

Getting the money refunded from an immigration consultant
Q: Dear sir/madam, I applied for an immigration program to Canada known as a startup visa through a consultant in Dubai and paid AED 85,000. The consultant has not been able to get me the letter of support that is needed to apply for immigration to Canada in the time frame mentioned in the contract. When I ask for a refund, the consultant does not respond.
