Drafting an agreement with business partner for debt

Q: We have an LLC company in Dubai for the last 12 years. We have bank liabilities with one of the UAE banks for which our sponsor has given a personal guarantee. To remove his personal guarantee he has agreed to make a partial settlement of the loan but needs confirmation from the company that when we win one of the arbitration cases and money which we get in Dubai court, he should have first right over that receivables from Court. The receivable amount will be more than what he will pay to banks. 1) Can we create such an agreement and will Dubai court accept this? 2) What is the procedure we can do and give him the confidence to pay money to the bank?

Is there any law that the employer has to pay the cancellation fees?

Claiming price of supplied equipment without confirming the order

Q: Hello, I hope all is well. I have an events company and a supplier has given me a quotation for a wedding free of charge with a design without asking for charges. The wedding had a lot of planning hiccups so it was dragged along but I promised to try to give it to him if it’s possible but had not confirmed either verbally or on a signed agreement. And till 2 weeks ago I told him I will need to use a local supplier rather than him but if I needed more equipment I would tell him and he replied by saying please do send me a list if u require anything. However, there is no signed agreement and the quotation was for 1.7 million dollars and there’s no agreement with him and the wedding is November 8-9, so I am sure he knew he wasn’t getting it. Is he allowed to file a case based on nothing written and signed because we all know no supplier works on anything without signed contract and deposit and that’s in every contract?

Q: A person`s visa, as a business partner, is held by a company who has ceased trading and the company licence expired in March 2019 and has not been renewed. The person wants to be released from the company sponsorship and there are no outstanding monies, BUT the company owner wants AED 2,000 to cancel the visa. Question 1. What can the person do? Termination of employment without a valid reason

Q: My company wants to lay me off until the end of this month due to cost-cutting, but until now I have not received a formal termination letter from them. Shall I still continue to go to work or not? Can I file a formal complaint against my company?

Claiming the security deposit back from the landlord

Q: The landlord is not returning the security deposit. I have vacated the apartment that I rent and satisfied all conditions as per the Tenancy Contract (painted the apartment, fixed and cleaned all -- this had been acknowledged in written by landlord`s deputy, cancelled all utility services and Ejari and delivered the landlord cancellation forms). Upon returning the keys, the landlord`s deputy said he would call me when the security deposit cheque is ready. He never called, my email requests are not answered, my calls are ignored since then. Now already 2 weeks. I do have proof of handing over the security deposit cheque (by the real estate agency that arranged the apartment rental), that it was cached by the landlord and a written acknowledgement that the apartment was handed over with no issues. س: مرحبًا، أدخلنا الوالدة من حوالي شهر لأحد المشافي الخاصة من أجل علاج ورم في الدماغ والورم كان في الجهة اليمنى بعيدًا عن جذع الدماغ. أخبرنا الطبيب أنه سيتمكن من إزالة الأورام وأن حالتها الصحية جيدة وتسمح بإجراء جراحة لها وهذا الكلام مثبت من خلال التقارير ولم يخبرنا شفهيًا أو كتابيًا أنه يمكن أن تدخل في غيبوبة. أجرى الطبيب الجراحة التي استغرقت 11 ساعة في حين كان مقرر لها 8 ساعات. بعد خروج الطبيب أبلغنا أن دماغها كان يعاني من الضغط وأنهم أغلقوا الجمجمة من جديد. حاول الأطباء اليوم الذي يليه أن يوقظونها ولم تستيقظ. بعد 3 أيام جاء الطبيب ليقول إن حالتها حرجة وهي بحاجة إلى عملية عاجلة لإعادة إزالة عظم من الجمجمة (التي أغلقها قبل 3 أيام) وقال أنه يجب أن تتم العملية اليوم ولكن غرفة العمليات ممتلئة فتأجلت لليوم الذي يليه؛ أي بعد 4 أيام من العملية الأولى. وبعد العملية الثانية، قال إن الوضع جيد وهو متأكد أنها ستستفيق وبعد اليوم التالي ذهب في إجازة لمدة 15 يومًا. بعد اليوم الذي سافر فيه، أتانا طبيب آخر ليخبرنا أن فرصة إفاقتها ضعيفة جدًا وهي في غيبوبة منذ شهر. ماذا يمكن أن نفعل في هذه الحالة؟

أعطيت شيكات لشخص باعتبارها ضمانًا لصفقة لم تتم. كيف أستردها؟

س: حررت ٣ شيكات (كل شيك بقيمة مليون ومائة ألف درهم) من الشركة باسم شخص وسيط كضمان، حيث وعدني بتدبير عقد مجزِ من جهة كبيرة - الوسيط لديه معارف ولا يعمل بالجهة. لم يتحقق العمل ولم يتحصل لدي المبلغ أصلاً فلم أستفد منه شيئًا. أخاف أن يقدم الشيكات للمطالبة القانونية. ليس لديه دليل على أنه قام بالعمل وأتمَّ الصفقة (لا عقد ولا فواتير ولا اتفاقية)؛ مجرد الشيكات بيده. كيف يمكنني إنهاء الأمر؟ هل أطالبه بالشيكات؟ أخاف أن يثور ويفعل ما أخشاه! وماذا إن قدم بلاغًا بهم؟ هل أكون ملزمًا؟ ما العقوبة الجزائية والمدنية لعدم السداد؟ أنا مرتبك صراحة ولا أعرف كيف أتصرف!
