What can I do in case of a violent father who abuses all family?

Q: Hi, I`m a 21-year-old daughter of parents residing in the UAE. My father is extremely abusive, both verbally and physically. My parents have been married for 22 years, and it`s been 19 years since we came to the UAE. My father has caused injuries to my mom and severely affected her mental and physical health. My father has been unemployed for over 10 years and my mother provides for the family. He has failed to educate me, protect me and my mother. He is extremely violent, and controlling and we have been living in fear, all our lives. Can I know the procedure to be done in case of domestic violence? And pls advise about the divorce procedures of the country.

How to act against abusive husband and retrieve the passport from him?

Q: Hi, My sister and her husband live in AUD. He was abusive and took all her gold and documents. They have a kid and she is pregnant as well. She called the police who took her to the station and then she moved to another relative`s house. The police said they can`t help as there are no bruises and it`s a family court issue. She has no document of her or her kid. What is the best course of action? She does not want to live with her husband for the time being and wants to travel to her parents.

هل تُحتسب أتعاب المحاماة ومصاريف الدعوى ضمن مبلغ المطالبة الأصلي؟

س: السلام عليكم، رفع دعوى تجارية جزئية في دبي قيمة المطالبة فيها 49.999 درهم + رسوم ومصاريف الدعوى + أتعاب المحاماة. في حالة الحكم بالمبلغ المطلوب بالإضافة إلى رسوم ومصاريف الدعوى وأتعاب المحاماة، هل في هذه الحالة يُنظر فقط إلى مبلغ المطالبة وتُعتبر قيمة الدعوى البالغة 49.999 درهم لا تتجاوز الخمسين ألف درهم وبالتالي يكون الحكم نهائيًا غير قابل للاستئناف؟ أم أن رسوم ومصاريف الدعوى وأتعاب المحاماة تدخل في حساب قيمة الدعوى وتجعلها في هذه الحالة تجاوز الخمسين ألف رهم وبالتالي يصبح الحكم قابلاً للاستئناف؟

Will you get a travel ban for failing to pay credit card debts?

Q: Hi Sir/Madam, My name is L. I had 3 credit cards debts and I was terminated from my job in Dubai in 2020 because of Corona. Since then I went back home but was still making the minimum payments to the banks until July 2021. Until now I am getting calls from those banks saying they will bounce the cheque and file a case against me. Since the new law has been passed, I know the bounced cheque can be directly be used as an execution deed without the need to go through a long civil case. My question is when I am back in Dubai, will I get a travel ban and/or jail term? If yes, then I am assuming it is for not honoring the judgment order, then what is normally the term? Kindly advise

How to get a tenant arrested to recover the due rent after eviction?

Q: Dear sir/madam, Currently, I have 2 enforcement cases against my tenant for failing to pay rent. He has been evicted from the flat. A travel ban was issued. An arrest warrant was issued. No action is taken by the police to arrest. There seems to be no response from the tenant side. The tenant owes around +200k AED. Kindly advise as I would like to hire a lawyer!

I am buying a mortgaged property in Abu Dhabi and want to guarantee my rights

Q: I am buying a mortgaged property in Abu Dhabi for which I`m required to make payment to the seller`s loan obligation before the Title Deed Transfer, so that bank can issue a mortgage loan clearance letter and release the original title deed document to the seller. Unlike Dubai, I understand there is no process currently in place to "block the property" with Abu Dhabi Municipality at the time the buyer gives a cheque (in the name of the seller`s bank) for the loan obligation. Therefore, my question is, how to minimize the risk of the buyer`s default, i.e., the seller does not transfer the Title Deed to the buyer after the buyer pays a cheque for all the seller`s loan obligation. Q: Hi, I have a pending case in Dubai court regarding my loan payment for that I have hired a lawyer but I`m not satisfied with his work. Can I change the lawyer? Will there be any issue if I do so? Should I pay the remaining fee?

س: مرحبًا، انتقلت لفيلا في دبي منذ سنة 2020 واستلمتها بنفسي من المتعهد وحافظت عليها كأنها لي وأكثر بحكم ان صاحب البيت في الخارج. دفعت مبالغ كبيرة لعمل الحديقة الخارجية والديكور وأخبرت صاحب البيت أن خطتي البقاء مدة طويلة ليكون بيت لعائلتي. بعد مرور أول سنة وقبل التجديد، أرسل صاحب البيت برغبته في زيادة الإيجار بمبلغ غير منطقي، فأرسلت ما أقرّته حاسبة الإيجارات في ريرا بأنه لا يحق له أي زيادة وبالفعل تم تجديد العقد. في نصف مدة العقد من السنة الثانية (أي بعد سنة ونصف من انتقالي)، أرسل صاحب العقار إنذار إخلاء لسبب البيع. أسئلتي: أولاً: هل يمكن الاعتراض على هذا القرار بما أنه لم يتم بيع الشقة حتى الآن؟ وإن تم البيع، فلماذا لا تكون لي الأولوية لتجديد عقد الإيجار مع المالك الجديد في حال لم يُرد المالك الجديد الانتقال لها؟ ثانيًا: عند انتهاء عقدي السنة الثانية، لن يكون قد مضى 12 شهرًا على الإنذار بالإخلاء، فهل يمكن المطالبة بتجديد العقد لبقية المدة المتبقية؟ ثالثًا: دفعت مبالغ كبيرة باعتبارها تحسينات للحديقة والديكور، فمَن يعوضني بسبب الإخلاء المبكر؟ مع إبداء رغبتي في الاستقرار في البيت منذ البداية؟ شكرًا جزيلاً!

Q: Dear sir/madam, Does an employer have the right to calculate the end of service money by applying the old labor law (considering only 7 days for 1st-year completion)?
