Claiming outstanding salary after termination in probation period

Q: Hello Sir. I am Dr Parag Pitti, a General Dentist. The clinic where I was working before, terminated me in my probation period without giving me any notice and then asked me for my passport for visa cancellation. Since it was my probation, I accepted the termination but asked for salary for the days I worked with them. They said they will give me the final settlement and asked me to give my passport for visa cancellation. Now, they have cancelled the visa but I haven’t received the salary. What should I do?

Responsibility for the maintenance of defects in a rented apartment

Q: I live in a 4 bedroom apartment in Deira/Dubai. 3 out of the 4 bedrooms have sewage leakage problem somewhere in the ceiling and the smell is horrible. The landlord refuses to fix the problem even though my tenancy contract clearly states that he must fix on his expense. To make the story short, After filing for a case against him at the RDC, It all went down to the police station where he refused to sign a paper that states his willingness to fix. Next, a Dubai Municipality official visited the apartment and submitted a report to the Land Department confirming that the apartment smells very bad. All meanwhile I refused to pay any rent to pressure this landlord to fix. So now 4 months have passed and the accumulated rent has built up to above AED 100,000. The landlord has filed a case to claim the rental amount. What to do? And how can he file a case against me at the RDC without the RDC asking him to fix the apartment first?! Can I refuse to pay this landlord? I think it is unfair to pay!

س: السلام عليكم، اشتريت شقة من شون العقارية سنة ٢٠١٥ ودفعت كامل المبلغ، لكن المشروع انسحب من شون العقارية عن طريق دائرة الأملاك والاراضي وأعطوه لمطور ثانٍ اسمه زنادو. المهم، بعد أن راجعت المطور الجديد قال لي اسمك غير موجود بالكشف المالي الذي استلمناه من شون وقال لي نحن عندنا عقد لشخص غيرك وهو الذي أرسلته شون إلينا. وبعد أخذ ورد طلبوا مني ورقة إعادة بيع من شون بالإضافة للعقد وهم موجودين معي، وبعد الاطلاع عليها قالوا لي أمورك سليمة لكن يجب أن تدفع مبلغ ٥٣٠٠٠ لكي يصدروا عقداً جديداً. قال لي أن هذا المبلغ لأنني أخذت الشقة بدون موقف سيارة ودائرة الاراضي فرضت موقف مع الشقة ويجب أن يدفع الشاري المبلغ. قلت لهم أنني لا أملك المبلغ حالياً فأعطوني مهلة، ولما رجعت بعد شهر ونصف ومعي المبلغ تفاجأت أنه ليس لي اسم عندهم وأبلغوني بضرورة إحضار أوراق فسخ العقد القديم مع المالك القديم من شون العقارية حتى يعتمدوا العقد الخاص بي. علما أن مكاتب شون جميعها مغلقة، وقد استلمت بريداً إلكترونياَ من المطور الجديد زنادو خلال المهلة يوضح فيه نسبة الإنجاز بالمشروع ومذكور رقم الشقة الخاصة بي. حالياً، هم غير معترفين بأي شيء. الرجاء أن تفيدنا أستاذي الكريم.

Q: Hello, My Moroccan wife (at the time of the incident, now divorced/ex-wife) was impregnated by an Emirati. I found out about it after I took her to Germany (my home country), thinking it`s my child. The baby girl was born there. I filed for a DNA test, which result was 100% negative, this was then legally confirmed by the German court. I am currently in Dubai and intend to locate the biological father, with the intention of him acknowledging parentage and taking legal responsibility. Is there a law firm specialized in such cases? س: السلام عليكم، عندي مشكلة مع شون العقارية بحيث أني أملك عقد الشقة ورسالة إعادة بيع، لكن صاحب المشروع انسحب منه وأعطي لمطور ثانٍ. راجعت المطور الجديد وأبلغني أن عقدي غير موجود عندهم والموجود عقد لشخص ثانٍ، وطلبوا مني لكي يعتمدوا العقد الخاص بي أوراق فسخ العقد القديم علماً أن شون العقارية مكاتبها مغلقة. هل من الممكن أن تفيدونا بشيء؟

Understanding liabilities before signing a debt settlement agreement

Q: Salam Naser, I was in dispute with a client over non-payments and now it`s the time we agreed to sign a settlement agreement. Her lawyer has sent the agreement letter which has the following two terms in it and which are not clear to me. It will be nice of you if you can guide me accordingly. "1. Indemnity The Parties agree that it shall indemnify and keep the other party indemnified from and against all liabilities, costs, expenses, damages and losses (including any direct, indirect or consequential losses, loss of reputation and all interest, penalties and legal and other professional costs and expenses) suffered or incurred by the party arising out of the other party carrying out its obligations under this Settlement Agreement or breach or negligent performance or non-performance thereof." Confusion, who will be the authority to define these losses...etc? It`s a very technical term. "2. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the Dubai International Financial Centre (DIFC), without giving effect to any choice of law or conflict of law provisions. The Parties consent to the non-exclusive jurisdiction of the DIFC Courts." Confusion, They`re mentioning DIFC law specifically, I don`t know the reason. Should it be the UAE courts laws in general? Your help and suggestion will be highly appreciated.

Arbitrary dismissal for requesting the payment of delayed salaries

Q: Dear Ma`am Good day to you, I am working in a company where they didn`t pay me for 5 months and I have asked them to do so, in order to leave for marriage on August 26, 2018 (Please note my visa expires on 18/09/2018). But the response from them was swift and fast and they gave me a letter of termination with notice period 30 days. I have refused to sign the letter. The company is not in a position to settle my outstanding salary gratuity and leave salary at the moment, as I have been informed so verbally.
