The possibility to outsource marketing and sales management to a UAE-based company

Q: Dear sir/madam, Can a foreign company (non-UAE company) have the option to appoint or outsource marketing and sales management in the UAE to a UAE-based marketing management company? The UAE-based marketing management company will promote their product, find the distributor and manage the sales through distributors. Is it possible?

Can the landlord change tenancy contract terms without consent of the tenant?

Q: My rent agreement includes 2 parking spaces (the landlord owns multiple units in the apartment complex). Now that it has come time for renewal, the landlord is saying only 1 parking space is assigned to the unit per the title deed and I will not have access to the other parking space, i.e. the contract will be amended when renewed to be now just 1 parking allocation. Does not seem legally right to me but if the landlord has found a legal loophole fair play to them - seems the clear black or white answer. Kindly advise if the landlord can do it or not. Is the employee liable to cover employment expenses in case of early resignation?

Q: In case of voluntary termination of employment by the employee, prior to completion of the first year of service, the employee will be liable to pay back, in full, all costs incurred by the company as a part of the employment process. Such costs may include but are not limited to the employee`s relocation costs and his family, air tickets, residence visa expenses, technical training course costs... etc. Further, the company will not be liable to bear any employee or dependents’ repatriation costs. Is this position correct?

س: السلام عليكم، تواصل معي شخص على الهاتف وطلب مني خدمة إنسانية. يريد مني إرسال نقود إلى سوريا بحكم إقامتي بين دبي وسوريا على أن يودع المبلغ في حسابي في الإمارات. وبالفعل أودع المبلغ في حسابي وقمت بتسليم الأمانة. يوجد بيني وبين هذا الشخص محادثات على الواتساب تفيد بأنه أودع المبلغ في حسابي، ولكن لا يوجد إثبات أنني قمت بتسليم الأمانة. هل يمكن له أن يشتكيني ويدّعي أنني لم أسلِّم الأمانة؟

استرداد مبلغ أخذته سيدة للشراكة ثم ادعت الخسارة

س: السلام عليكم ورحمة الله وبركاته، اتفقت مع سيدة على الشراكة في محل تجاري. حولت لها المبلغ تحويلاً بنكيًا وبعدها لم أسجِّل اسمي بصفة شريكة. كانت تتهرب وبعد شهرين من التحويل، أرسلت لي رسالة أن خذي أغراضك من المحل فقد خسرنا وسلمت أختي المحل وليس لك شيء عندي (علمًا بأن المحل موجود وهذا الكلام منذ عام ٢٠١٩). طالبتها بإرجاع المبلغ وقالت ليس لك شيء عندي وبعدها حظرت رقمي. حاولت أحل الموضوع معها بدون محاكم ولكنها لم تستجب لي. توجهت للمحكمة ورفعت قضية والمحامي طالب باسترداد الدين الذي في ذمتها بدون شرح تفاصيل الموضوع. جاء ردها بأنها تنكر المبلغ وبعدها أقرّت أن التحويل كان بهدف الشراكة في محل وليس قرض. طلبت المدَّعَى عليها بتوجيه اليمين الحاسمة أن المبلغ قرض وليس لهدف الشراكة. أنا لم أحصل على الشراكة ولم يتم استرداد المبلغ. ما الحل؟ جزاكم الله كل خير!

How to guarantee getting my labor rights after resigning from my job?

Q: I am working for a company in Dubai since 2009. I am on an unlimited contract and planning to resign by the end of next month. The company is going thru financial issues for 6 years and the employee benefits are not settled for all employees who resigned in the last few years. I need your advice on how to begin the legal process and get the gratuity and other pending benefits from the company if I would have to proceed legally. I shall tender my resignation by end of Feb 2022. Also, would like to know the expenses incurred by me if I am moving forward legally by hiring a lawyer.

Is deducting half the salary considered a breach of the employment contract?

Q: Hi, I am working with an employer in Dubai since October 1st, 2021. The company is deducting salary in the name of consultancy as I was got hired from India. But there was no such contract between employee&employer for deduction in salaries. Still, the employer deducted my half the salary for 2 months and I requested to stay at room till the company gets new project also they have taken my educational certificate stating it is the company policy. I have already emailed the company to pay me a full salary for staying in the room or give me NOC. 1. Can I resign from the company without a notice period as I am in probation period and my contract is limited? 2. Q: Hi there, With COVID travel issues, it`s increasingly hard to administer my CR in Bahrain. What is the best way to establish a new power of attorney to allow a firm in Bahrain with an advanced e-key to execute Sijilat type activities on my behalf (CR renewal, change of address... etc.)?
