A tenant offers to pay rent after 30-day notice: What are my options?
Q: Dear Sir/Madam, Rental dispute with my tenant. Timeline of events: 1. Cheque due date: June 8, 2023. 2. Gave him 25 days as requested. 3. Raised a formal police complaint for a bounced cheque (as the account was closed/fraud) on July 3, 2023. 4. Again asked him to pay up or vacate; he asked for more time and I gave him more time. 5. Sent him a formal 30-day legal notice to pay and vacate the property on August 2, 2023. 6. On August 24, he called me to offer a partial payment; I said he had to pay in full by the due date. 7. On August 25, I received the RDC notice of offer and deposit, in which he stated the following: "The applicant requests your kind approval to accept an offer and deposit a cash amount of AED XXX in exchange for the rental value." If I accept the notice, how much time will he be given by the court to pay the amount? If I reject the offer, what will be the implications? Can I leave my job without notice if I found a better job offer?
Q: Respected Sir, I have completed 8 months in a company and it was mentioned in the contract that after completing 6 months of probationary period, the salary will be revised. Can I evict the tenant when I buy a new property with the intention to rent it for a higher price?
Q: Hi There, Here is my current situation: I have just bought a property, and the previous landlord issued an eviction due to the intention to sell, valid until 9th Nov 2023. It was sent by Dubai Courts, and the previous tenant acknowledged it. The new tenant is refusing to leave and said that I have to serve a new 12-month notice to them. I do not want to send a new notice, as I do not plan to live in the property, I plan to rent it (they are paying 42K AED under the market and not even covering the mortgage) for a few years before moving in. My questions: a) Can I send a legal letter from a notary public, referencing the previous notice which is still valid, from Dubai courts? b) If so, can I legally evict them on the agreed date, and will RERA be in my favor? c) If they do leave, am I able to rent the property?
