دعوى فسخ العقد بسبب شرط فاسد

س: السلام عليكم ورحمة الله وبركاته، عينت مستشار هجرة لكندا من الأردن بتاريخ ٢٤/٦/٢٠١٤، وكان أحد الشروط أن أحصل على ٧/٩ في امتحان اللغة الإنجليزية. كان هناك مرفق للعقد عبارة عن كمبيالة بقيمة ٤٠٠٠ دولار تحدد العلامة المطلوبة في كل جزء من أجزاء امتحان اللغة الإنجليزية، وأن أدفع هذا المبلغ إذا لم أحصل على العلامة المطلوبة في كل جزء. وقعت على الكمبيالة فارغة، وقال المحامي إنه سوف يملأها بنفسه بعد أن يتأكد من العلامات المطلوبة، حصلت على ٧/٩ في امتحان اللغة وأخبرت المستشار بذلك عبر الهاتف بتاريخ ١٥/١٠/٢٠١٤ ورد علي بأن علاماتي بأجزاء الامتحان تقل عن المطلوب وإنه سوف ينزل إعلان لي في الصحف الكندية ليجد لي فرصة عمل في كندا لتدعم ملفي عند دائرة الهجرة الكندية. لم يتواصل معي بعد ذلك، اتصل بي محامي المستشار قبل حوالي أسبوعين بتاريخ ٢٢/٧/٢٠١٩ وقال لي إنه يجب أن أدرس وأحصل على العلامات المطلوبة وهي ٧ في القراءة و٧ في الكتابة و٧ في المحادثة و ٨ في الاستماع، وإذا لم احصل عليها فيجب أن ادفع ٤٠٠٠ دولار حسب العقد والكمبيالة والا سوف يقدم الكمبيالة للمحكمة ويسجنني. برجاء إبداء النصيحة وفقكم الله.

Forcing the employer to cancel the visa and take another job

Q: Hello. Kindly advise on the following matter. I am employed in the free zone in Dubai. My name is in the trade license and I am registered in the company as a manager. In March, I resigned from the company. The employer doesn`t want to cancel my visa and to revoke me from the license. Authorities of the free zone told me they cannot do anything because my name is in the license and employer has to first appoint another manager and then cancel my license. In case they don`t want to do it, I can only go to the court (they don`t know which type exactly...). How can I enforce my visa cancellation? Only by court order? Which kind of court? I have found another job but I`m stuck on the old company visa. Please advise. Thank you

Can the employee claim additional damages if the company ceased operation?

Q: Dear Mr Bakheet, The company that I have worked at for 4 years as a regional sales director had decided to cease its operations in the Middle East and Turkey (my scope). The management took this decision to protect global profitability and to increase the shareholder value. 3 weeks ago, the decision had been announced in that way over a webcast to all the employees. Instead of complete closure, the legal entity will be kept but the payroll will be terminated by end of September after a legal notice period of one month (I have received today itself), which will be starting the beginning of September. The company offers the legal end of service based on fix salary only without any additional damages payment or commissions included. Is there any additional damages payment by the UAE law? Any ex gratia practice in this case?

Which one prevails in case of contradiction, offer letter or labour contract

Q: I have a notice period of 90 days as per my offer letter, whereas as per my labour contract registered with JAFZA it is 30 days. Please let me know which one will prevail over the other. I would also like to mention that it is specified in my offer letter that in case of conflict between the labour contract and the offer letter, the terms of the Company`s offer letter will prevail.

Appealing a judgement of paying half labour dues and claiming full pay

Q: I`ve filed a case against my ex-employer (Bahrain) for my indemnity and EOS. The lower court gave a verdict in my favour and around 40% of the total money which I claimed. Then the case was transferred to the high court and was again in my favour with the same amount. It means the employer has to pay me around 40% only of the total amount. This verdict came 3 months before and my lawyer keeps saying that till now he didn`t get a full judgment so he doesn`t know the actual amount. And now, he is saying the amount is the same which the judge wrote in the verdict i.e. 40% of the amount. I have all proofs where my employer said that they have to pay me the full amount. Now please guide me on what I should do. My lawyer is saying that we can`t do anything, this is the final decision. This means, I won the case but actually I lose. Can I challenge this decision?
