إخلاء العقار من قبل المالك الجديد

س: السلام عليكم، أود الاستفسار من سعادتكم عما يلي: بتاريخ ٢٠ ديسمبر ٢٠٢١ اشريت عقارًا وسجَّلته باسمي، وهذا العقار مُؤجَّر حتى تاريخ ٩ فبراير ٢٠٢٢ عن طريق المالك القديم (أي بتاريخ الشراء، كان متبقي ٥٠ يوم على انتهاء الفترة الإيجارية). بصفتي مالكًا جديدًا، أخطرت المستأجر أنه في حالة رغبته في تجديد عقد الإيجار الحالي يجب زيادة الأجرة حسب شروط دائرة التنظيم العقاري أو إخلاء العقار عند انتهاء عقده في ٩ فبراير ٢٠٢٢ لكنه رفض الزيادة و رفض الإخلاء. أصر المستأجر على دفع قيمة إيجار أقل من سعر السوق وأقل من السعر الاسترشادي لدائرة التنظيم العقاري؛ معللاً ذلك بأنه كان ينبغي عليّ بصفتي مالكًا جديدًا للعقار أن أخطره قبل ٩٠ يومًا من انتهاء العقد، علمًا بأنني اشتريت العقار يوم ٢٠ ديسمبر ٢٠٢١ أي قبل انتهاء عقد الإيجار الحالي بحوالي ٥٠ يوم فقط. عقد الإيجار الحالي هو باسم المالك القديم حتى تاريخ ٩ فبراير ٢٠٢٢ و ليس باسمي ولم أوقعه. رجاءً أفيدوني بموقفي القانوني مع مراعاه أنني لم أوقع عقد الإيجار الحالي والذي سينتهي في ٩ فبراير ٢٠٢٢ فهو مُوقَّع بواسطة المالك القديم. جزاكم الله خيرًا!

An employee has two contracts with the same company. Which one is correct?

Q: Good afternoon, I have a question. I have an unlimited employment contract with a company in RAKEZ Free Zone. In this employment contract, it states that I have a 6- months probation period with 1-day notice during the probation. Then, I have another employment contract from the company and it states a different probation period (3 months). Which contract is legally the correct one? And when I resign (I am in my 5th month now), can I use the 1 day notice period? Thank you so much for your help!

مستحقات العامل لدى إنهاء خدمته من قبل صاحب العمل بعد بدء المدة المُجَدَّدة

س: السلام عليكم ورحمة الله تعالي وبركاته، الأستاذ الفاضل تحية طيبة! لدي عقد إلكتروني مع الشركة لمدة 6 سنوات من 13/12/2015ومذكور انتهاء العقد بتاريخ 12/12/2021 ويُجدَّد لمدة عام. أُنهيت خدماتي بتاريخ 14/12/2021. السؤال: هل يتم حساب مدة خدمتي باعتبارها 6 سنوات أم 7 سنوات؟ علمًا بأنه مذكور في العقد أنه في حالة فسخ العقد تُدفع أجرة شهر. تحياتي!

إمكانية قبول كفالة متهم بتهمة حيازة مخدرات بقصد الاتجار

س: السلام عليكم، قُبض على شخص بتهمة حيازة مخدرات بقصد الاتجار لأول مرة وليس له علاقة بهذه الأمور. هل يمكن قبول الكفالة بعد ١٤ يومًا من أول مرة أم لا يوجد له كفالة؟ أرجو الرد!

س: السلام عليكم، أنا موظف في شركة سائق على باص ركاب. اختلفت مع الشركة من أجل رواتب سنتين لم تُدفَع. فصلوني فصلاً تعسفيًا. رفعوا قضية سوء الأمانة المُشدّدة عن نواقص على المركبة؛ مثل زامور ولمبات صغيره وعدة مع سبير؛ مع العلم أنني لم أستلم أي شيء من هذه العدة، والزامور واللمبات متعطلة؛ أي محروقة لأنها مُستهلكة وهذا شيء طبيعي. أخذت جميع أغراضي الشخصية التي اشتريتها من جيبي الخاص؛ مثل مسجل وركاية، وهي إضافات خارجية، مع وجود شهود كُثر من موظفي الشركة يشهدون بأنني لم آخذ من المركبة إلا أشياء اشتريتها أنا ولم آخذ أي شيء من المركبة، ولا يوجد كشف استلام بيني وبينهم.

س: مساء الخير، أرجو إفادتي! اتصل أخي هاتفيًا بشخص صديق له وطلب منه مواد مخدرة. عند الذهاب له، داهمت الشرطة المكان وهو كمين مسبق، وعند التفتيش لم يجدوا معه شيء داخل المكان وبعد ذلك فتشوا مركبته أسفل البناية فوجدوا معه مواد مخدرة وأفاد أنها استخدام شخصي له ولم يعترف بغير ذلك. بماذا تُسجّل هذه القضية؟ وما حكمها إذا تكرمتم؟ شكرًا جزيلاً!

How to file a performance order lawsuit against a company and its managers?

Q: A civil company that I had dealings with has 2 partners. Each partner is also the manager of the company. The civil company had sent me a statement of account and a letter acknowledging a debt. Asking not to file a civil case and wait for about a month upon cheque bounce

Q: Hi Mr. Ibrahim, If you have time, I need your opinion on my question. I decide to move a case I need to do it with someone who knows the local law. I have a bounced cheque from a financial institution in the UAE in the amount of 550,000 AED. The CEO who gave me the cheque closed the account after issuing the cheque showing proof that his intention was not to pay. When I deposited the cheque, he requested a 2 weeks period to pay me 20% of the amount and begged to wait and not to file a case as he will pay the rest by mid-January. I have 2 questions: 1- I know that there are changes to the law effective 2nd January, would these changes affect the fact that the cheque bounced in December? 2- Is partial payment a way to block the case and take it to loops for years?
