Q: I am a French Morrocan Muslim woman. I got married to a Jordanian man in Dubai at the court; Islamic wedding. We moved to Jordan. We had then 3 kids. We got separated. Two years and a half later, I had no news nor any financial help whatsoever. I asked for a divorce from France. The judgment is soon. I don’t know if he divorced me. I am moving soon to the UAE with my kids and my new fiancé. Am I safe to go live in the UAE? Can my ex-husband ask for the custody of the kids or did he lose it forever? The tenant did not send an eviction notice as per the contract. What to do?

Q: Hi, The tenant in my apartment did not give the 3 month-written notice as per the contract. The contract expired 01/10 and he called me on 28/09 to say that he wants to leave! I didn`t take the keys and sent an official court warning to pay the penalty and the rent as I did not take the apartment keys even although the contract expired. س: حُكِم في دعوى عمالية بتاريخ ١٩/١٠/٢٠٢١ ثم تقدمت الشركة بطلب الاستئناف بتاريخ ١٤/١١/٢٠٢١ ثم نُفِّذ الطلب بتاريخ ٢١/١١/٢٠٢١ (علمًا بأن مدة الـ٣٠ يوم انتهت يوم ١٨/١١/٢٠٢١). استلمت رسالة من المحكمة بإعلاني من مكتب إدارة الدعوى الاستئنافية لحضور جلسة يوم ٢٤/١١/٢٠٢١. ما جلسة إدارة الدعوى الاستئنافية؟ وهل مدة الاستئناف تُحسَب من تاريخ تقديم طلب الاستئناف أم بعد استكمال وتسجيل الطلب في مكتب إدارة الدعوى؟ هل يحق لي المطالبة بعدم قبول الاستئناف لانتهاء المدة؟ وهل في حالة عدم قبول الاستئناف يصبح الحكم نهائيًا وأتقدم بطلب التنفيذ؟

س: السلام عليكم، اشتريت شقة بدبي على الخارطة عام 2005 من مطور عقاري معروف على أساس التسليم عام 2008 ولكن تأخر استكمال بنائها لغاية 2020 وقد دفعت ثلاثة أرباع القيمة وبقيت دفعة التسليم. هناك بند غرامة تأخير ولكن المطور لا يعترف بذلك ويدعي وجود ظروف قهرية آنذاك وأنه اضطر لرهن العقار مدار البحث للحصول على قرض من البنك ويصر على كامل المبلغ ليتم التسليم. أرشدوني ماذا أفعل لاسترداد حقي بعد هذا الانتظار الطويل؟ علمًا بأن القيمة السوقية للشقة حاليًا تقل عن المبلغ الذي دفعته للمطور حتى الآن؟ ولكم عاطر التحية!
