س: السلام عليكم، هل يحق للشركة التي أعمل بها قانونًا رفض الاستقالة؟ وما التصرُّف القانوني الذي عليّ فعله في حالة رفض الاستقالة لكى تصبح استقالتي نافدة بدون أن أخسر مستحقاتي؟

س: السلام عليكم، هل يجوز الاستئناف على حكم عمالي قيمة المطالبة فيه 30315 درهم وتم الحكم فيه بـ 26310 درهم؟ مع العلم أن المُدَّعَى عليها فتحت استئناف وقُبل الطلب. هل يجوز ذلك أم لا؟

Q: I had defaulted on cheques with some banks in the UAE, and now they are saying that they will go for a civil case. If they go for a civil case, what are the consequences? Is there any travel ban or any issues in renewing the visa?

Can I change my current visa without terminating my labor contract?

Q: Dear Sir, Regarding the golden visa, I applied and got approval. My question is, without the cancellation of the labor contract from the present company, can I cancel my present visa? Will I be able to leave the UAE if I have an active loan and credit card?

Q: I have a working visa in the UAE and I have a personal loan and a credit card with a bank (current account as a salaried employee). I am planning to leave the UAE for personal reasons but I am planning to repay the debts (I will also have business trips back to the UAE). My question is - once my visa is canceled will I have issues exiting the country due to unpaid loans? I do not have overdue payments and always pay on time.

The borrower has given a cheque while the bank account is closed. What to do?

Q: Hello, When I finished my prayer and was leaving the mosque, an individual approached me and asked me to drive him to a near destination. On the way, he told me that he has financial difficulties and his sick wife needs a flight ticket to travel. He kept mentioning: "I’m not a beggar and I have a business". He showed me his valid visa and offered to give me a cheque to ensure that he’ll pay me back. It has been around a month and he is not paying me back. He also said that his account is closed so the cheque won’t work. I’m not sure what to do now? Should I check the cheque and if it bounces, what do I need to do next? Your help is appreciated! س: السلام عليكم، سؤالي عن الديون المالية التي ترتبت على أحد الشركاء في مؤسسة ذات مسؤولية محدودة. كان الهدف من الديون وقيمتها 200 ألف درهم تأسيس الشركة. الشركة بها شخصين (شركاء)؛ الشريك الأول أعطى شيك ضمان مقابل الدين للدائن. استولى الشريك الثاني على مدخول الشركة وأبدى عدم استعداده للتعاون مع الشريك الأول لتسديد الالتزامات المترتبة على الشركة، بالإضافة إلى حكم من لجنة فض المنازعات الإيجارية بدفع قيمة إيجار سنة على الشركة. كل ذلك يتحمله الشريك الأول حاليًا لأنه هو الذي قام بالاقتراض ووقّع عقد الإيجار مع المؤجر. قام الشريك الأول بإلغاء الرخصة التجارية بعد صدور حكم المحكمة بالتنفيذ لسداد قيمة شيك الضمان، وإلغاء الرخصة تم بعد صدور حكم لجنة فض المنازعات بفرض قيمة الإيجار على الشركة. كيف يمكن للشريك الأول تقاسم هذه الأحكام والمقدّرة بـ 300 ألف درهم مع الشريك الثاني المتهرب من جميع تلك الالتزامات؟ وهل يمكن السير في إجراءات تصفية الشركة بعد إلغاء الرخصة التجارية؟ وهل يمكن إيقاف إجراءات تنفيذ قضية الشيك (الدين) لحين الانتهاء من تصفية الشركة؟ وشكرًا لكم!

How to file a divorce in the UAE between two expatriates married outside?

Q: A marriage between Greek National and Indian origin was solemnized in India at Delhi marriage courts. Living in Dubai since 2015 as she was based in Dubai and then in Nov of the year 2016, a child was born and she moved back to Greece. Since then, she has disappeared and On 11 Oct 2018, she was granted ex-parte divorce in her home country in Cyprus on many grounds, and the document was shared by her. As the marriage was solemnized and registered in Delhi under the Christian marriage act in India and this document was invalid to grant me a divorce. Hence, in 2019, I filed a case in Delhi seeking divorce against the ex-parte decision received also contesting the grounds of divorce granted. Since then, the lawyer in Delhi has sent three notices through registered post on WhatsApp asking the respondent to be present, however, no response was received. I fought the case in the UAE and got a divorce on the above grounds. Is it valid for submission to the Indian consulate in the UAE? How long will the UAE courts take?

س: السلام عليكم، لدي دعوى عقارية وقد تأخَّر المطور في إنجاز المشروع. أخطرت المطور بإشعار إنهاء عقد موثّق من الكاتب العدل وبإعلان بالنشر. بعدها سجلت قضية لفسخ العقد واسترجاع المبلغ المدفوع لشراء الوحدة، وفي أثناء نظر الدعوى، أرسل المطور إيميل لي بإخطاري بسداد المبلغ المتبقي وباستلام الوحدة. هل هناك قانون يجيز أن تعتبر الوحدة قد سُلِّمت لي بموجب البريد الإلكتروني من المطور أثناء نظر القضية ولم يصدر فيها حكم بعد؟
