مدافعة دعوى طلاق للضرر رفعتها الزوجة أثناء وجود الزوج خارج البلاد

س: رفعت زوجتي قضية طلاق للضرر ضدي وقت سفري للخارج وذلك بالضغط من أهلها، وقالت في لائحة الدعوى أنني هجرتها ولم أنفق عليها ولا على طفلي الاثنين وأنها استأجرت سكنًا خاصًا بعد أن تخليت عنهم، وهو لم يحدث جملة وتفصيلاً، وهناك ما يُثبت. تركت لهم المصروف الخاص بالبيت وهناك رسائل واتساب تشهد بذلك قبل السفر. ولكن لظروف مرض كورونا المنتشر حاليًا، لا يمكنني العودة بسبب إغلاق المطارات؛ ومع ذلك لا توجد مشكلة في إيجار السكن ولا المدارس وهناك مصروف لهم يكفي لمدة سنة. هل إن رجعت وقدمت ما لدي من مستندات تفيد بأنني أخبرتها بسفري لرؤية الوالد، ولدي عقد إيجار للسكن صالح لآخر سنة ٢٠٢٠، وحتى رسوم المدارس تُخصَم من حسابي في البنك مباشرة، يرفض القاضي طلب الطلاق للضرر؟ لقد أعدت حجز الأبناء في المدارس عن طريق الإنترنت للسنة القادمة ٢٠٢٠/٢٠٢١، هل هذا يكفي لرفض طلبها؟ مع العلم أن الزوجة لم ترفق أي ورقة في الدعوى تُثبت إدعائها بأنها قامت باستئجار سكن. أنا أملك تلك المستندات باسمي وجميع الرسوم المدرسية والسكن وقد أبلغتها عن طريق الواتساب بغرض السفر. مع العلم بأني مقيم في إمارة دبي.

Calculation of the gratuity after reducing salary for COVID-19

Q: I am working in a company now for 11 months and 17 days. My company is offering me a 50% salary cut due to COVID-19. If I accept, how will my gratuity and leave salary be calculated? My basic is 4500 till now. And as per new contract, it is 2500. Confused. Please help.

س: السلام عليكم، تزوجت في العام ٢٠١٢ ولكن قبل الدخول وبسبب خلافات تم الطلاق (وذُكِر أنها لا تحل له إلا بعقد ومهر جديد في حال الرجوع مرة أخرى). تم الصلح ولم يُحرَّر عقد جديد لجهلي بتلك الإجراءات، وحتى أبو الزوجة لم يطلب ذلك ولم نطلب شهود أو أي شيء آخر. تزوجنا وبيننا أبناء، حدثت خلافات مرة أخرى الآن في المحكمة والزوجة مُصرَّة على الطلاق، المشكلة أنها استعملت عقد الزواج القديم في القضية، وهناك عقد طلاق بعده، ما القانون المعمول به في هذه الحالة؟ هل هناك مُساءلة قانونية للطرفين؟ مع العلم بأن عقدا الزواج والطلاق الأُوَل كانا في بلدنا الأم وليس في الإمارات. وفي حال علم القضاء بورقة الطلاق، ما تبعات ذلك على الطرفين؟ تم نسب الأطفال بعقد الزواج القديم وليس هناك أي عقد زواج بعده. شكرًا!

Housing allowance obligation of a terminated employee during COVID-19

Q: Under the Ministerial Resolution 279 of 2020, are the employers required to pay all allowances (housing, transportation, insurance) except for wages for employees that they terminate? If so, for how long will they have to pay for this? Until they cancel their visa, 30 days after cancellation of visa, as long as they are in the UAE or until the end of 2020? What if the employee does not leave the UAE, but gets an investor visa within the 30 days of cancellation, will the Employer still be liable to pay allowances once the employee gets the investor visa since the employee has not left the UAE?

Failing to pay off-plan property instalments and terminating SPA

Q: I have booked a unit under construction with a developer 3 years ago. I paid 30% during construction and 70% was due since Jan this year. When I booked the unit, my plan was to get financing from a bank to cover 70% payment because I was working with a semi-government company. But I lost my job and my credit score went low due to defaulting on financing payments and I could not get financing from the bank. I have contacted the developer asking them for refund or change of payment plan but they give me instalment plan for 5 years and increased the price which I cannot go for. The developer completed 100% construction and they sent me a building completion certificate in Jan this year and now they are calculating 3% late payment fee every month as per SPA.
