س: أعمل في تنظيم الفعاليات وقمت بتأجيل إحداها بناءً على قرارات الإجراءات الاحترازية الصادرة من الجهات المعنية، وحاليًا يطالبني بعض العملاء برد المبالغ المُسدّدة منهم، كما أرسل أحدهم إنذارًا من محاميه. هل أنا مُلزَم بالسداد بالرغم من عدم إلغاء الفعالية وإنما تأجيلها لحين السماح بتنفيذها من الجهات المعنية؟ وكيف أرد على الإنذار؟

Q: We are setting up a dropshipping business in the UAE & KSA which will be merely an online store with no physical operations in the targeted countries. Our suppliers will have full ownership of sold products, though the product’s journey and the delivery will be via the suppliers` courier partners. Termination of a property SPA due to COVID-19 situation
Q: I have made a 20% down-payment against an off-plan property in 2017. The sale & purchase agreement does not include a "Termination/Refund" clause and the property is due for handover by the end of the month. The property value has dropped by 40% and I`m able to only get a mortgage for 80% of the current value. However, due to the current situation and the impact of COVID-19 financially, I`m not in a position to proceed with the remaining instalments. I have to forfeit the contract as the developer has not given me any options for deferral of payment and has declined the request for a delayed handover. Please advise if and how I can get a refund on the 20% amount that has already been paid upfront.May 20, 2020

The right to claim refund from developer for breach of obligations
Q: I had invested in a project in Dubai in Oct 2018, in a 3 bedroom townhouse. I have paid them 24% of the house amount till now but haven`t received anything except for SPA and receipts from them. No registration of the property has also been done wherein we were supposed to get the house in Dec 2019 the handover. On checking, we got to know that they haven`t even got permission from the land department for that particular row of townhouses in which we had booked our unit, and no construction has also happened till now. They offered us another unit instead to take which they claim will get finished in Dec 2020. But because they have been lying to us since the beginning and have taken money from us without any permission being in place, we want to exit from the agreement and get our money refunded. Wanted to know what are we eligible to get money in this case? Seeking the correct advice. Please help.May 19, 2020

Claiming the advance payment back while the company is not responsible for the delay
Q: We are a contracting company based in Dubai. We entered into a contract with our client two years ago, the client released the advance payment at the start. They have caused delays at the site due to which we weren`t able to proceed with the work for this duration. We were recently invoiced charges for the delay but they aren`t ready and are now trying to terminate us from the contract. They are asking us to repay the advance payment made in 2018 April. Our contracts do not carry any clauses for the security of advances or liquidated damages. Can they still claim back the advance even though we were not the ones responsible for causing the delays? What are the options we have to move forward with this situation?
