س: لدي حرمان دائم بسبب عدم دفع مخالفات إقامة 4 أشهر. منذ سنتين عملنا استرحام ووافقوا عليه ولكننا تأخرنا في الدفع. تم إرجاع المبلغ لنا وإلغاء المعاملة. سنتان على هذا الحال. زوجي مقيم وكانت إقامة ابني سارية عندما غادرت. أنا الوحيدة لدي مشكلة. هل يوجد لديكم حل جذري؟

رفع دعوى ضد مطور بسبب تغيير الغرض من استخدام العقار

س: اشتريت شقة فندقية في دبي من مُطوِّر وأُخطرت بالتسليم في نوفمبر 2020. أخطرني وكلاء المطور عبر الهاتف أن الغرض من استخدام العقار قد تم تغييره من شقق فندقية إلى سكنية وأرسل لي ملحقًا للعقد للتوقيع عليه ورفضت. في شهر أبريل 2021، قام المطور برفع شكوى إلى دائرة الأراضي في دبي لإنهاء العقد بدعوى أنني لم أدفع الدفعة المتبقية من سعر الوحدة وقد أرسلت لي الدائرة إخطارًا و قد قمت بالرد بأن السبب هو التغيير في العقد من المطور وأنني على استعداد للدفع في حالة بقاء التعاقد كما هو (شقق فندقية). قامت الدائرة بإرسال إيميل إلى المطور و كان رده: "يرجى التكرم بالعلم بأن المشروع مكتمل الإنجاز وأن النسبة المدفوعة من قيمة الوحدة العقارية حتى تاريخه هي فقط 30% من سعر العقار، كما يرجى العلم بأنه لا يوجد أي تغيير في مواصفات الوحدة العقارية وعليه يتوجب على المستثمر سداد المبلغ المترصد، وخلاف ذلك، نرجو من سيادتكم التكرم بإعادة الإجراء لقسم الشؤون القانونية لاستكمال إجراءات الإلغاء حسب القوانين المتبعة". أرجو من سيادتكم التكرُّم بالنصح علمًا بأن إجراءات استلام الوحدة لم تكتمل وبأنني سوداني الجنسية ولست مقيمًا في دولة الإمارات.

Termination for defaulting on the payments of a purchased apartment and claim of refund

Q: Defaulting on property installments and refund from the developer I have purchased a unit from a developer. According to them, the project handover was meant to be December 2019 but did not complete until mid-year 2020. Due to the issue with the developer`s payment platform from Nigeria being blocked by a firewall and some unexpected banking/financial regulations in Nigeria limiting the amount of foreign dollar transactions for the month, I can’t continue to pay the installments, due to which I have some penalty amount as well. I received a letter from the land department (Oqood) requesting the termination of my unit. My question is if my unit is terminated, will I get the refund of my monthly payments. On the document sent to me, It is stated that. Paid amount: AED 154,260,000 Claimed amount: AED 189, 540,000 Thanks

Can you resign when you are still in the probation period?

Q: Good day! I`m working as a servant with 2 yrs visa but still, I`m under a 6 months probation period and I want to resign. I`m not happy with the wife of my sponsor because of so much attitude. How to fix a bank loan that was approved without knowing and after leaving the UAE?

Q: This is for my friend. She had initiated a loan through a UAE bank about 2 years back but then she had to leave the country and no loan was processed. Now the bank has told her that the loan has been disbursed and she needs to pay Dhs. 440,000/-. They have even told her that they put a criminal case against her but not divulging any details of the case. They keep chasing her but she hasn`t received a dime nor used a single penny. She did have an existing personal loan with another bank which the new bank was supposed to take as a buyout. She has been diligently paying her existing loan with the bank. Even the salesperson told her that the other bank has made a mistake. Since they filed a case against her, she cannot come to the UAE and hence making the matter difficult for her. What can be done in this case and how to resolve this? Please advise. Can she give me a POA to act on her behalf and coordinate and check bank activities and talk to the branch office manager of the bank?

Asking to vacate the apartment 2 months before the end of the contract

Q: Dear Sir/Madam, My tenancy contract is ending on 28th November 2021. My landlord verbally expressed his intentions to sell the property on 19th August 2021. Later on 5th September 2021, he sent me an email asking me to vacate the apartment at the end of the contract period (28th November 2021). Is this legal or does the landlord have to give me a 12-month notice while renewing the contract? What are my options in this scenario?

Non-payment of salary for 18 months. What to do?

Q: I have an unlimited contract since October 2019 with a company registered in DMCC Dubai. I did not receive any wage (basic salary, bonus, accommodation allowance, business expenses reimbursement) since March 2020 (18 months) and no health insurance coverage since October 2020. The company is just promising. The company decided first to reduce salaries by 50% due to Covid for three months (Apr-Jun 2020) with my acceptance. After that, they continued with the same reduction without my agreement. But even with that, no salaries are paid. The total amount due is above 500,000 USD. I was obliged to leave UAE in November 2020 because of no income. It has been agreed and accepted by the company to work remotely. I was also obliged to go back to Dubai at my expense every 6 months in order not to lose the visa. Now, I have a job offer in another country starting in Oct 2021. How to proceed with my company? How to inform them? Would I resign and file a claim later or file a claim immediately without resignation?
