How to claim the labor dues from a business after working with them online?

Q: Hi there, I used to work online for a business that operates out of Dubai. I have a large sum of unpaid wages owed to me by my former employer. I can see online that they continue to operate and receive clients. They have also put on other employees who continue to work in the business. I have made several attempts to recover my unpaid wages yet have not been successful in doing so. Finally, I am looking to take formal proceedings against my former employer. As I do not live in Dubai, what grounds can I be covered on, If any at all?

How to file a performance order lawsuit against a company and its managers?

Q: A civil company that I had dealings with has 2 partners. Each partner is also the manager of the company. The civil company had sent me a statement of account and a letter acknowledging a debt. They confirmed in writing that they will pay me AED 153,500 on 10th September 2021. The letter is on the company`s letterhead and has the sign of one of the two managers/partners of the company. They did not pay me till now. I wish to register a Payment Order/Performance Order (Amr Al Arida) lawsuit against the company since my right is unconditionally confirmed in writing. QUESTION: Should I make the lawsuit only against the civil company as respondent, or should I also mention the two managers/partners as respondents i.e. a total of 3 respondents? Please guide me. The company is not canceling the visa after serving the notice period. What to do?

Q: Dear sir/madam, I submitted my resignation and I`m about to complete 30 days` notice period (I work under an unlimited contract). My management is not ready to relieve me and will not cancel my visa. What can I do? I have to join the new company on Jan, 5th.

Asking not to file a civil case and wait for about a month upon cheque bounce

Q: Hi Mr. Ibrahim, If you have time, I need your opinion on my question. I decide to move a case I need to do it with someone who knows the local law. I have a bounced cheque from a financial institution in the UAE in the amount of 550,000 AED. The CEO who gave me the cheque closed the account after issuing the cheque showing proof that his intention was not to pay. When I deposited the cheque, he requested a 2 weeks period to pay me 20% of the amount and begged to wait and not to file a case as he will pay the rest by mid-January. I have 2 questions: 1- I know that there are changes to the law effective 2nd January, would these changes affect the fact that the cheque bounced in December? 2- Is partial payment a way to block the case and take it to loops for years?

س: السلام عليكم، اشتريت شقة في الشارقة وتأخر المطور في التسليم لمدة سنتين وأربعة أشهر. أرسلت له إخطار عدلي من المحكمة في الشارقة بتاريخ التسليم وكان رده بأنه ملتزم بدفع بدل الإيجار عن الوحدة عن مدة التأخير. الآن العقار جاهز وتبقى مبلغ 90 ألف. طلبت منهم خصم مبلغ بدل الإيجار من دفعة التسليم ولكن المطور لا يريد دفع شيء ويماطل. اليوم أرسل لي إنذارًا يطلب مني استلام العقار ودفع دفعة التسليم خلال ٧ أيام وإلا سيلجأ للقانون. ما موقفي؟ وماذا يجب أن أفعل؟ العقار في الشارقة والعقد موثَّق. التأخير سنتين وأربعة أشهر. كان رد المطور على الإخطار العدلي أنه ملتزم بدفع بدل الإيجار. الآن لا يريد دفع شيء. ماذا أفعل؟ قيمة العقار مدفوعة كاملة ما عدا 90 ألف دفعة التسليم. أنا أطالبه بأن يخصم بدل الإيجار لكي أدفع الباقي وهو يرفض دفع أي شيء.

How to recover the amount of a bounced cheque without filing a civil case?

Q: Dear sir/madam, I registered a case against a company for a cheque bounce totaling AED 660k. The manager was arrested and then released and now the owner has been caught who flew into Dubai and was caught at the airport. What do I need to do now? If I don`t file a civil case, what happens in that case? And if I file a case in court, how much do I need to pay? My business is at loss and I can`t afford any more expenses. I came to know that after paying a fine of AED 5k, these guys will be free and can travel out of the country. In that case, they will never pay my money, and if I file a civil case, I will just keep incurring more expenses. Is this right?

Q: Hi all, I hope you are well! I have a question regarding a dispute with my employer and I am currently awaiting for hearing on my case. I have submitted my resignation with the intention to complete 30 days notice period due to false allegations leveled by the employer. It did not go down well with them and refused to accept my resignation and took my laptop and access card and sent me a termination letter after 4 days. It was an arbitrary dismissal with a refusal to accept my resignation. My question is whether I will be correct to put forward a claim for arbitrary termination and a claim for damages per court decision including my gratuity and pending leaves. The employer has no intention to make payment and is threatening me with a police case and a bad referral for future employment. Please guide me on this situation as I wait for a hearing from the Dubai court. Thank you in advance!

The right of the tenant to contest an eviction notice that has never been delivered

Q: As a tenant, I would like to understand if an eviction notice that was formalized through a notary public but was not properly addressed, is still valid and enforceable. I would also like to know if I need to contest it (which is a costly matter) or if I can just ignore it (and wait for the landlord to start a dispute or send a new notice). The specifics: The rental management company claims that my landlord has sent a formal eviction notice through notary public 4 months ago. However, I`ve never received this. The rental management company sends me a photo of the eviction notice and Aramex delivery slip via WhatsApp. However, on the eviction notice, the rental management company is listed as the notified party. And the Aramex slip also shows that the documents have been delivered there. The rental management company claims that the notary public is saying it has also been delivered to my house. Is the eviction notice valid and enforceable? And if not, should I contest it through RDC?
