Q: My husband works in a semi-government company in Dubai. Due to certain suspicious activities, the company has started an internal audit and found some financial scam against his manager. Later on, his manager absconded. The company has terminated my husband giving the restructuring as a reason. Though till time there are no charges against my husband, the employer has taken his passport. The employer is saying as he is the witness and passport is with the company, as soon the police tell him to release the passport he will hand it over to us. He doesn`t know how much time the police will take. It`s been 3 months without salary (one-month suspension and 1 and a half month termination). Now, can the employer put any criminal charges against us after termination if we are going to file a case against him in the labor dept.? We have no idea whether the employer has done a police complaint or not. Please note we have already taken a police clearance certificate and went to the police station 2 times and found no criminal charges against him.

Q: Assalamu Alaikum We are 4 partners in a business and one of the partners wants to sell his shares to two existing partners in the business without the consent of the 4th partner. There is no provision made in the MoA regarding the sale/transfer of shares. So can this be done without violating any law in the UAE? Thanks

How to convince the bank to reschedule personal loan payments?

Q: Hi, I have an ongoing personal loan with a bank, the current outstanding principal amount is AED 80,000/. This is through my salary account and until today, I haven’t missed even a single payment. Here, I have requested my bank to reschedule the current outstanding principal amount which is AED 80,000/- over 4 years of tenure but they have rejected my request and provided me with a reason that my Etihad Bureau Scores are low. I have explained to them about the previous scenarios where I wasn’t able to pay on time for my credit bills and there were some other late payments related to the telecommunication. Long story short, They are not providing me with any assistance. As of now, for me; paying an EMI of AED 4,800 every single month seems very difficult. Please advise.

س: السلام عليكم، تعرضت لوعكة صحية عبارة عن أعراض تقل في الصدر وألم في ذراعي الأيسر يوم 24/10/2021. توجهت إلى عيادة التأمين الخاصة بالعمل وشرحت لهم الأعراض المؤلمة وانتظرت لكي يأتي دوري للتشخيص ومن ثم أدخلتني الممرضة غرفة لإجراء رسم قلب. أُجري رسم القلب ومن ثم أدخلوني للطبيب الموجود الذي أخبرني أنه لا يوجد لدي أي مشاكل صحية وأنه عبارة عن ضغط أو شد أعصاب، وكنت قلقًا بسبب تلك الأعراض التي لم أتعرض لها من قبل فسألته؛ هل هي جلطة أو انسداد شرياني فأجابني بالنفي واستبعاد تلك الأمور. طلبوا مني التوجه إلى طبيب آخر في بر دبي ولكن طلبوا مني الانتظار لحين التواصل مع هذا الطبيب وتحديد موعد لي ولكن بلا جدوى. انتظرت طويلاً وفي النهاية أخبروني أنه عليّ دفع رسوم رسم القلب وأخبروني أنه يتوجب عليّ انتظار مكالمة من الطبيب الآخر ولكن كانت حالتي تزداد سوءًا فتوجهت إلى مستشفى راشد وقد تأخرت بسبب الوقت الذي أمضيته في العيادة الخاصة بالتأمين. أجروا لي فحوصات أخرى وتبين أنها جلطة قلبية وقاموا بإجراء قسطرة ودعامة عاجلة لي وأخبروني أني تعرضت لموت جزء من أنسجة القلب بسبب التأخير والحمد لله على كل حال. هل أستطيع تقديم شكوى أو مقاضاة تلك العيادة بسبب الإهمال في حالتي؟ وشكرًا!

Precautions while signing a property purchase MOU via POA and giving cheque

Q: I am going to buy a property through an agent in a registered company. Just before signing an MOU and giving a 10% cheque, we came to know that the owner is not here and the stated name in the MOU is the holder of POA (power of attorney). What should I do in this situation? With whom to sign the MOU and under whose name is the cheque to be given? They put the name of the POA holder but the title deed has the name of the owner. Should we ask for POA and get it verified? How to verify it?

Q: Hi, Hope you are doing well. I was just wondering if it is legal for a company to provide a positive google review about themselves. I have been dealing with a car garage and I think they are taking advantage of me and letting me pay for their mistakes, brought the car in 4 times already and spent more than AED 4000 and now it`s still not fixed.
