Is the employee liable to cover employment expenses in case of early resignation?

Q: In case of voluntary termination of employment by the employee, prior to completion of the first year of service, the employee will be liable to pay back, in full, all costs incurred by the company as a part of the employment process. Such costs may include but are not limited to the employee`s relocation costs and his family, air tickets, residence visa expenses, technical training course costs... etc. Further, the company will not be liable to bear any employee or dependents’ repatriation costs. Is this position correct?

استرداد مبلغ أخذته سيدة للشراكة ثم ادعت الخسارة

س: السلام عليكم ورحمة الله وبركاته، اتفقت مع سيدة على الشراكة في محل تجاري. حولت لها المبلغ تحويلاً بنكيًا وبعدها لم أسجِّل اسمي بصفة شريكة. كانت تتهرب وبعد شهرين من التحويل، أرسلت لي رسالة أن خذي أغراضك من المحل فقد خسرنا وسلمت أختي المحل وليس لك شيء عندي (علمًا بأن المحل موجود وهذا الكلام منذ عام ٢٠١٩). طالبتها بإرجاع المبلغ وقالت ليس لك شيء عندي وبعدها حظرت رقمي. حاولت أحل الموضوع معها بدون محاكم ولكنها لم تستجب لي. توجهت للمحكمة ورفعت قضية والمحامي طالب باسترداد الدين الذي في ذمتها بدون شرح تفاصيل الموضوع. جاء ردها بأنها تنكر المبلغ وبعدها أقرّت أن التحويل كان بهدف الشراكة في محل وليس قرض. طلبت المدَّعَى عليها بتوجيه اليمين الحاسمة أن المبلغ قرض وليس لهدف الشراكة. أنا لم أحصل على الشراكة ولم يتم استرداد المبلغ. ما الحل؟ جزاكم الله كل خير!

How to guarantee getting my labor rights after resigning from my job?

Q: I am working for a company in Dubai since 2009. I am on an unlimited contract and planning to resign by the end of next month. The company is going thru financial issues for 6 years and the employee benefits are not settled for all employees who resigned in the last few years. I need your advice on how to begin the legal process and get the gratuity and other pending benefits from the company if I would have to proceed legally. I shall tender my resignation by end of Feb 2022. Also, would like to know the expenses incurred by me if I am moving forward legally by hiring a lawyer.

Is deducting half the salary considered a breach of the employment contract?

Q: Hi, I am working with an employer in Dubai since October 1st, 2021. The company is deducting salary in the name of consultancy as I was got hired from India. But there was no such contract between employee&employer for deduction in salaries. Still, the employer deducted my half the salary for 2 months and I requested to stay at room till the company gets new project also they have taken my educational certificate stating it is the company policy. I have already emailed the company to pay me a full salary for staying in the room or give me NOC. 1. Can I resign from the company without a notice period as I am in probation period and my contract is limited? 2. What should I do if the company doesn`t pay me my salary for the days I am staying in the room? 3. Can this be considered a breach of contract by the employer?

Q: Dear Sir or Madam, A Moroccan citizen who lives in Dubai owes me money. I live in Europe and have never been to the UAE. I met this man in Morocco in 2014. Later he sent me a friend request on Facebook. He manipulated me to loan him money via Western Union with various excuses multiple times. It started when he was still in Morocco in 2016. He promised to repay me when working in the UAE. He moved to Dubai in 2017, but money requests didn’t stop. I made six transactions between Jan 24, 2017, and Mar 9, 2018, total 1150 €. I have Fb chats (also a voice message) as evidence. He promised to pay AED 500 per month but never paid. In Feb 2019 he blocked me on Fb when I demanded him to pay. On WhatsApp, he still promised to pay me when he could. I tried to be patient because of the coronavirus pandemic. In Dec 2021 he blocked me also on WhatsApp. Can this be considered a crime in the UAE? Can I file a criminal complaint against this person online? How is the limitation period calculated in this case?
