Q: Sir,
I am currently in India. An offer letter was sent to me by an employer and I have signed it.
Later, I came to know that this company tortures the workers and even salaries are not paid in time. I am scared.
A week ago, they sent me an email asking me to sign "prerequisite for the issuance of work permit", which I have not yet responded.
Will I have to face a ban if I do not sign it? Can they issue a visa for me without me signing it?
Please help me.

I have given resignation during my probation period (within three months), and I want to know if I have to pay any compensation to the company.

Repercussions of resigning during probation to take a better offer

Q: I found a job in JLT a month ago and now I got a better offer from a Mainland company, which I want to accept their offer.
I am still on probation with a 2-year contract, but it clearly mentions that both parties can terminate the contract within the notice period.
So not sure if it's a limited or unlimited contract. Didn't inform the employer yet.
What will the process look like? Will I be banned? Should I pay a fee?

س: أعمل لدى شركة في الإمارات. بعد أن أُجري تعديل وضع وتصريح عمل وتوقيع عرض عمل، أكملت شهر ونصف وقدمت استقالتي رسميًا لصاحب العمل قبل فحص الدم و إجراءات الهوية، إلخ.
صاحب العمل لم يلغِ تأشيرة العمل، بل سمح لي في الفترة المتبقية من الـ ٦٠ يومًا بالبحث عن عمل آخر، وحين أجد عمل، سيتخذ اللازم لتحويل الإقامة.
الأسئلة:
١. هل يلزمني شهر إنذار إضافي كما هو موضَّح في عرض العمل؟!
علمًا بأن الفيزا مدتها ٦٠ يومًا فقط مضى منها شهر ونصف عمل ولم أوقِّع على العقد الرسمي.
٢. كم عدد أيام السماح بعد إلغاء فيزا العمل (٦٠ يومًا) لتعديل وضعي بعمل زيارة جديدة ؟
٣. هل سينطبق عليّ قانون الحظر التلقائي لمدة سنة و لم أوقِّع على العقد الرسمي بعد؟!

قام شخص بسبي أمام شخصين وقاما بإبلاغي وقالا أنهما سيشهدان معي، وذهبنا إلى النيابة بعريضة لوكيل النيابة.
وبعد ذلك اتصلا بي وقالا أنهما غيرا رأيهما بالشهادة، مع العلم أنهما قاما بكتابة العريضة وتوجد أرقامهم وبياناتهم الشخصية.
هل يحق لهم ذلك وما العقوبة المترتبة لذلك؟

دفع مستحقات الموظف بعد صرفه وقبل إلغاء الإقامة 0
لقد قامت الشركة بفسخ عقد العمل غير المحدد (فصل تعسفي) في شهر يوليو وأعطي لي شهر إنذار ولكن لم آخذ مستحقاتي منذ ذلك الحين لوجود بناتي على مقاعد الدراسة حتى الآن حتى 11/7/2019 والبحث عن وظيفة أخرى في هذة المدة وإقامتي تنتهي في 11/6/2019.
قامت الشركه بتعيين موظفين آخرين منذ ذلك الوقت. فوجئت باتصال من الشركة يجبرني على إلغاء الإقامة الآن وإلغاء إقامة الأهل والبنات أولاً وأنهم غير مسؤولين عن تكملة البنات لدراستهم.

كنت قد أخذت قرض في الإمارات من مؤسسة مالية قيمته ٤٧٠٠٠ درهم وغادرت الإمارات. أريد أن أذهب إلى السعودية.
هل سيكون هناك منع أو أي ملاحقة هناك لأني أريد أن أسافر للعمل لكي أسدد ديني؟ وللعلم أيضاً، كنت أعمل في السعودية لمدة عام قبل السفر للإمارات.

Termination without notice for making a salary complaint 0
I worked in a company for more than 5 years. I was terminated (with notice period) after I made a salary complaint.
The labour researcher said it might not be arbitrary dismissal because I'm on an unlimited contract, saying any party may terminate the contract as long as there is notice period. So I didn’t push for it.
We haven’t settled my gratuity yet, but they want to deduct my lates and absences. As of now, I'm just assuming they want to deduct all my lates and absences from my joining date until my last day.
I admit that I have many lates and absences (sick leaves) in my entire employment with them, but they never issued any written warning or imposed any fine as disciplinary actions - they didn’t deduct anything on my salary following every incident.
Is it legal for the company to deduct lates and absences on my gratuity?
Can they count the lates and absences from my joining date until my last day?
Or only for the past few months, or 1 year, or start on my latest renewal date?

Notice period for resignation during probation 0
Hi,
I am working in Dubai under an unlimited contract. As per the labour contract, the probation period is 6 months and I resigned from the company in Jan.
The notice period is 3 months from both parties but I am not sure if resigning during the probation requires this notice period of 3 months.
Please advise if they have any right to hold my salary in case I resign and leave the company.
