Q: Hi,
I have put 5% deposit on a property in Dubai and I have also paid 2% DLD fees + OQOOD. I have more payments starting in 2 weeks but I can't afford to continue with the purchase.
Am I entitled to any money back?

Q: REFUND FROM UNPROFESSIONAL DEVELOPER, NO CONTRACT, NO OQOOD, NO PROGRESS
We purchased properties with Royal Estates in DIP - we have paid approximately 25% of the final value already, however they have broken the law on at least 2 issues, as they haven't given us a contract within 15 days of our reservation form plus there is no Oqood. There is no work on the site also.
The developer is constantly making excuses for past two years and is most unprofessional and unhelpful - they are unlawfully keeping our money. The reservation form is null and void as we purchased in 2015.
Is there a way we can get a straightforward refund from the Escrow account that DLD holds? There's no point for a court case as there's no challenge with the developer - anyone can see they have breached law, and I'm sure Dubai want to keep a good reputation to foreign investors without making things legally expensive and messy.
Your advice on the law for this simple situation is appreciated,

Refusing to refund reservation down payment upon cancelling a unit

Q: I was in a process of buying a property in Dubai from a developer.
Their sales representative advised me to put a deposit of AED 10,000 to reserve the unit. We agreed the value can be fully refunded if I cancelled within 10 working days.
A few days later, I requested to cancel my reservation and refund my money back. They refused to refund my money back.
I have supporting documents which prove my agreement with them in the form of:
- The email in which I reserved the unit list the terms & conditions (which I have written)
- I have an updated payment form from them and hand wrote the condition of unit reservation (full refund if cancelled within 10 working days)
- Exchanged WhatsApp with their sales representative.
They claim that the above proofs are not enough to support my claims, and so they are refusing to refund my money back.

Obtaining refund from the developer for project delay

Q: I booked an off-plan studio in R.E.P. DIP. The developer posts to me the contract to sign. I signed the contract and posted it back to their address.
The texture property In Dubai has been dealing and I transferred 10% to reserve the unit in June 2015. I have paid over 30% until the end of Dec 2016.
I stopped paying the rest of instalments because after viewing 0% construction report through DLD website and neither developer has provided me Oqood.
There is still no construction as per the DLD report for project number 1514. I am considering to get a refund.
The total price of the studio is AED 330000. 10% at the outset, 36 equal instalments during construction, 20% on handover and 18 equal instalments after the handover.
I have paid 10% and 18 equal instalments out of 36 during the construction as per contract. Total AED 109,973.94 paid: AED 109,973.00
What are the possibilities to get a refund from the developer? How much would it cost?

My wife booked a villa with a developer in Dubai. 30% of the amount has been paid so far.
Due to financial constraints, she cannot continue the further payments.
Is there any law in the UAE to claim a refund from the seller?

Rescinding a property reservation agreement and getting refund

Q: I have purchased a property in Dubai in Dec 2017 by putting a 30% deposit of the purchase price to the Developers account and received the reservation form and receipts only.
However, I still do not have the SPA or OQOOD as of Aug 2018. The developer has been saying the SPA templates have been getting delayed at DLD.
Per the reservation form, I have an upcoming payment in Sep 2018, however, I do not want to pay this as I still don't have the SPA or Oqood which is my legal document and there is no escrow account per DLD website.
What is my legal position here and how can I get this resolved or can I get refunded given there is no contract as yet?

How to cancel an off-plan property contract and get the paid money back?

Q: Hi,
I bought an off-plan property from a developer in November 2022 and signed a sale and purchase agreement (SPA).
The handover is scheduled for 2026, and I have paid 20% of the total amount. However, my financial situation has changed and I can no longer afford to make the payments.
The developer has informed me that if I cancel the contract, I will forfeit my deposit and be liable for cancellation fees.
I would like to know if there is any legal way to cancel the contract and get my money back from them.

Refund of a deposit paid by the underage buyer of real estate property 0
I put a deposit down on two "off-plan" properties. I paid a deposit on both and received a reservation document signed and stamped by the developer.
However, at the time of the deposit, I was under the age of 21 which is the minimum age to purchase property in Dubai. Lastly once the deposit was made I never received an SPA or NOC. Have now been sent a notice by Dubai Land Department on the request of the developers for Property Termination procedure. The request was canceled.
I am now trying to figure out how to get my deposit back as I believe since I was underage and no formal contract was presented or signed, the agreement is void.
