Why is my cousin in Sharjah CID custody for 3 days without charges?

Hi,

My cousin has been taken into custody by the Sharjah CID police, and when asked, they said “suspicious.”

He has not done anything and has no cheque case.

It’s been 3 days since he has been under police custody.

Hello,

I’m sorry to hear about your cousin’s situation!

Please visit the Sharjah CID police station to request details about his detention. It’s important to engage a lawyer immediately to protect their rights and get updates on the case.

If your cousin is a foreign national, contact your country’s embassy for assistance. Keep all records of communication, and if no clear information is provided, you may escalate the matter to the Public Prosecution.

Let me know if you need help.

Ok, thanks for the information. Does Sharjah police detain someone for no reason for 3 days? Or only 48 hours?

Sharjah police—or any UAE police—cannot detain someone without a legal reason.

According to UAE law, a person can be detained for up to 48 hours at a police station for initial investigation and questioning.

After this period, the individual must be presented to the Public Prosecution, which can then decide to release, extend the detention, or proceed with charges.

In some cases, initial detention for questioning can last up to 72 hours (24 hours for suspicion and 48 hours before prosecution involvement).

Still, any further extension must be legally justified and approved by the prosecutor or a judge.

Detaining someone for three days (72 hours) without charge is only possible if it is part of the legal investigation process and proper procedures are followed.

Otherwise, detention beyond 48 hours without presenting the person to the prosecution is not allowed under UAE law.

If you believe someone is being held without a proper reason or legal process, you have the right to seek legal assistance and request clarification from the authorities.

Hello,

In the UAE, only a lawyer can access full details of the case, meet the accused in detention, and represent him before the prosecution.

A lawyer can:

- Check if any charges are filed,

- Request bail or release, and

- Ensure your cousin is treated fairly and his rights are protected.

If you require our assistance, kindly share your WhatsApp number.

Hire a local lawyer immediately to:

- Inquire officially with CID or the Public Prosecution about the reason for detention.

- Submit a formal petition for visitation or release if no charges are filed.

- Ensure his rights are not violated during detention.

If no lawyer yet, you (or a close relative) may visit the Public Prosecution Office in Sharjah and file a written request to know the basis of detention.

Request visitation or submit a power of attorney if a family member wants to represent him.

If you need legal representation or assistance with the petition, please share your WhatsApp number.

Appoint a lawyer who can directly get information and defend your cousin.

Be persistent: Families sometimes get little information at first, but persistence (with lawyer involvement) often speeds up clarification and release.

Don’t Panic: Many “suspicious” detentions are resolved with clarification and formal paperwork, and the absence of any known legal case against him is in his favor.

Request basic welfare: If you have access, ask that he be given medicine, food, and allowed to contact his family.

If you wish to be represented, please contact us.

Thank you for contacting us via Legal Advice Middle East!

There are several legal possibilities behind a CID detention labeled as “suspicious,” especially when there are no known criminal charges, like bounced cheques.

In similar cases we've successfully handled, the detention was linked to identity verification issues, unconfirmed reports from third parties, or ongoing investigations in which the detained person was not initially a suspect but was temporarily held for clarification.

The most strategic course of action is to appoint a legal representative to submit an official inquiry at the Sharjah CID branch and request clarity on the legal basis of the detention.

If no formal charges are filed within a legally defined timeframe, the individual must either be released or referred to the prosecution.

We’ve assisted families in identical situations where the individual was released within a few days once we submitted a formal representation and ensured that the procedural timeline was respected by the police.

We can guide you through the process and assign a defense lawyer to act immediately. Our multilingual legal consultants (Arabic, English, Russian, Hindi, and Chinese) are ready to assist.
