Proceeding with a labour case at the court for unpaid salaries
Hi,
I want to file a case against my last employer who has failed to settle my last 6 months' salary, and the settlement is approximately more than AED 100,000.
I went to Tawafoq Center and registered my complaint. They tried to arrange a meeting, but my employer is not responding at all.
So they transferred my complaint to the court and gave me the referral documents.
Now, I don't have enough money to hire a lawyer or pay any court fee. I don't know the procedure too.
Kindly advise me on the proceedings.
As per the established procedure of a labour claim, you can proceed with the case to the court as you have got the referral documents of transferring the matter to the court.
There is no court fee for your case. All you have to bear is the cost of typing charges, and if you can afford a lawyer, you need to pay some amount advance.
Regarding the remaining balance, you can pay it after finishing the case or you can hire any lawyer just to prepare your legal documents.

Regarding your matter, if your claim is only100k, you will not pay court expenses. But if it’s above that, you have to ask the court chairman to collect court expenses from the recovery.
And regarding the procedures, you are required to attend by yourself in all court sessions because you don’t have a legal representative.
You should know also that you are required to translate all the English documents into Arabic so you have to pay those expenses.
