Q: Madam,
I work for a Dubai company. My friend/colleague expired in August 2018 while he was on duty in Dubai.
What is the procedure for claiming the end of service benefits? His wife already got the Power of Attorney from India, attested by the Indian embassy.
Kindly help to know the procedures to claim. She is planning to come to Dubai next month for processing this.
Thanks & Regards

How to follow a civil execution case against a company after brother's death?

1
Q: We are Hindu. My brother expired in the UAE recently.
A) My brother had registered a civil execution case in Dubai courts.
I have applied for a succession certificate. Is this sufficient for me to register my name in the execution court as the person who will make petitions and collect any payments that the debtor makes?
Or do I have to mention this existing lawsuit in the inheritance file?
B) A company had issued an acknowledgment of debt in the name of my brother, but they refuse to pay.
What steps do I need to take at family court for the inheritance so that I can, later on, start a commercial lawsuit to collect the debts that the company owes to my deceased brother?
Do I need a letter from the family court that allows me to start a commercial case on behalf of my deceased brother?
Thank you!

How to continue the file for inheritance of brother after filing the case by sister-in-law?
1
Q: My brother passed away last year at the workplace and as per the Dubai Court, his inheritance is shared by his widow, 3 children and old-aged parents.
I am their only son left now to take care of them. My father is 77 years old, he's bed sick for 3 years now and cannot move and my mother is also 70 years old.
My question is which Dubai court department to approach and what documents are needed to collect their inheritance amount on their behalf from the Dubai Court?
The case was filed by my sister-in-law.

Issuing a legal heir certificate in the UAE to get the property of an Indian deceased mother
3
Q: Dear sir/madam,
My mother recently passed away in Dubai on Feb 22. Now, our family is planning to travel to India to complete the pending formalities like closing the bank account which was under her name, and transferring the land which was in her name to my father.
My mother was an Indian national and was a UAE resident. A little research in Google suggests that I would need a legal heir certificate and possibly a succession certificate, is that right?
Please advise!

My uncle passed away in the UAE and we made a POA from the heir in India. What's next?

0
Q: Asking on behalf of my uncle's family who recently died at his workplace in the UAE.
The company PRO told me that we need to prepare a Power of Attorney in order to get the following:
1. Death compensation (Diya/blood money)
2. Gratuity
3. Pending Salary + Any outstanding payments
4. All other financial + legal documents
We have prepared the Power of Attorney in India and the following has been done from our side:
1. Sign the power of attorney before a notary public in India
2. Ministry of foreign affairs Attestation in India
3. Certified by the UAE Embassy/Consulate in India
Now, my main question is what has to be done with this Power of Attorney in the UAE now?
Is there a standard process?

How to get bank statements for deceased non-UAE resident with a POA?
1
Q: Hello,
I have a special situation that I need assistance with, and I would probably benefit from a further consultation session:
A friend of mine, who is a non-UAE resident, has some bank accounts in the UAE. He passed away, and his son contacted me to ask if I could inquire about his father's bank account (to get statements, not to act on them).
My friend passed away outside of the UAE, and his son lives outside the country (Jordan).
The son made me a power of attorney in Jordan, which was attested by the MOFA in Jordan and the UAE Embassy.
However, when I asked the bank about this, they told me that it would need to go through the Dubai Courts and that I might need to hire a lawyer to do this.
Is there a way for me to get the bank statements on his behalf? If so, what are the required documents?
