Claiming the unpaid price of items delivered to the client

Dear Sir,

Would like to know how I can deal with the following situation.

I am the MD of a granite exporting firm in Andra Pradesh, India. In Sep 2018 I had delivered two containers of granite to a company in Ras Al Khaimah.

The understanding was AED 10K on the delivery of container and the remaining 35K within 3 months as PDC. However, the client gave only 5K as cash on delivery and so far has been giving various excuses (in between around 45 days he was in India). The PDC date was in Dec 2018.

My company is not registered in the UAE and we have delivered the container on CNF. The cheque issued is on my name and is from the client's company.

I need to know what I should do to recover the money. I have a residence visa in the UAE.

Thanks

Sajan

Hello,

In our law firm, we can help you claim the amount due. It is possible to do it even if you are not in the UAE.

The first thing we do in these cases is to send a legal notice to the other party claiming the money and see what they respond to.

Please email me for more details

Thank you,

Kind regards

Dear Questioner,

After reading your query, I understand that a RAK company owes your company in India around AED 40K following delivery of granite.

From the initial reading, your matter has got a good potential to file a recovery case and also to get an award in your favour from the RAK commercial courts.

I would like to see the following documents before commenting anything further on this matter

1. All invoices pertaining to the transaction

2. All purchase orders

3. All delivery notes or delivery confirmations

4. Statement of Accounts confirmed by the other party [if any]

5. Any agreements signed by the parties pertaining to the transaction [to check whether there is an arbitration clause.]

6. Mail communication pertaining to outstanding

7. Full address of the other party including the street name and landmark

Please send me the above-mentioned documents to have a quick review and response.
