Yes, it is possible to reinstate your initial complaint with MOHRE/Tasheel, provided that the case was not formally registered in court.

However, the process depends on the status of your previous complaint and the reason for its closure. Certain cases may require resubmission or additional approvals.

Dear questioner,

Sometimes MOHRE accepts; you can try with them. If you need further clarification, kindly share your WhatsApp number.

Dear Questioner,

Thank you for reaching out regarding your concern!

Yes, it is indeed possible to reinstate or refile your initial complaint with the Ministry of Human Resources and Emiratisation (MOHRE) or Tasheel, even if the court case was not registered.

Here’s what you can do:

- Contact MOHRE/Tasheel:

You should reach out to the relevant authority where you initially filed your complaint (either MOHRE or Tasheel) to inquire about reopening or reinstating your complaint. You may need to provide the original complaint reference number or details about the prior proceedings.

- Clarify Status:

If the court case was not registered or if your initial complaint was dismissed for administrative reasons, you can discuss with the authorities about re-opening your case and taking the next steps.

- Documentation:

Please ensure that you have all the necessary documents, such as your original complaint, employment contract, and any evidence supporting your case. These documents will assist in the process.

- Consultation with a Lawyer:

If you face challenges during the process or need further assistance, I recommend consulting with a labor lawyer who can guide you through the complaint reinstatement process and ensure that your rights are protected.

- Alternative Dispute Resolution:

If necessary, MOHRE or Tasheel may offer mediation or arbitration services before escalating the matter to court.

Please do not hesitate to reach out if you need any further guidance or assistance.

Best regards,

I went to the Abu Dhabi Labor Court and MOHRE, but they were of no help. Any suggestions? Would I have better success with Tasheel or Abu Dhabi Labor Court services? Do I need a document from the Abu Dhabi Labor Court showing that my case is "not registered"?

Thank you for your update!

If you have already visited the Abu Dhabi Labor Court and MOHRE without success, here are some suggestions that might help move things forward:

- Follow Up with MOHRE/Tasheel:

If you did not get sufficient help previously, I recommend visiting Tasheel or MOHRE again, ensuring you have all relevant documents in hand, including any reference numbers or case IDs. If you still don’t receive proper assistance, ask to escalate the matter to a higher authority or supervisor.

- Abu Dhabi Labor Court:

If your case was not registered, it’s a good idea to request a formal document from the Labor Court confirming that the case shows as "not registered" or was not processed. This document can be useful for proving the situation when approaching other authorities.

- Legal Advice:

If the issue persists, it may be beneficial to consult with us to better understand your options and assist in navigating the next steps. They may help refile the case or approach the issue from a different angle.

Should you need any further assistance or guidance on the matter, feel free to reach out. I’m here to help.

Dear Sir/Madam,

Thank you for your inquiry regarding the possibility of reinstating an initial complaint with MOHRE/Tasheel after a court case was not registered. Please find below a professional response:

1. Reinstating a Complaint:

If the court case was not registered within the stipulated timeframe after receiving a No Objection Certificate (NOC) from MOHRE, reinstating the initial complaint may not be straightforward. MOHRE typically adheres to strict procedural timelines.

After receiving an NOC, claimants are required to register their case with the UAE Labour Courts within 14 days. Failure to do so may result in the closure of the initial complaint.

2. Limitation Period for Filing Claims:

UAE labor law imposes a limitation period of 2 years from the date when the entitlement becomes due (typically at the end of employment). If this period has not elapsed, you may still be able to initiate a new complaint process through MOHRE or Tasheel.

3. Pre-Litigation Requirement:

Before filing a formal case in labor court, claimants must first submit their complaint to MOHRE or the relevant free zone authority for mediation. If mediation fails, an NOC is issued, allowing the claimant to proceed with court registration.

Recommendations:

- Contact MOHRE: Reach out to MOHRE or Tasheel directly to confirm whether your initial complaint can be reinstated or whether you need to file a new complaint.

- Legal Consultation: Consult with a legal professional specializing in UAE labor law to explore your options and ensure compliance with procedural requirements.

Should you require further clarification or assistance, please do not hesitate to contact us or seek professional legal counsel.

Yours sincerely,

ABDUL WAHIED
