Are there any legal restrictions on discussing psychedelics in a UAE-based podcast?

Hi,

I am looking to start a podcast discussing psychedelics and my experience with psilocybin in a clinical setting. I will cover new research while making it clear that I am not suggesting illegal use of these substances.

I was wondering about the regulations in the UAE regarding discussions on psychedelics. A few years ago, a medical conference featured a speaker on psychedelic research, so I assume discussing the topic is not illegal.

It’s a very niche subject, but I would appreciate your advice on whether starting this podcast would be possible.

Thanks!

Dear Inquirer,

Thank you for your inquiry!

While discussions about psychedelics, including research and clinical settings, may not be explicitly illegal in the UAE, it's important to approach the subject with caution.

The UAE has strict laws regarding the use and promotion of controlled substances, and content promoting or suggesting illegal usage could lead to legal consequences.

Given the sensitive nature of the topic and the legal implications, we recommend a legal consultation to ensure your podcast complies with local laws and regulations.

For tailored advice and to discuss potential risks, book a consultation with us.

Best regards,

In the UAE, the regulations surrounding substances like psychedelics are strictly governed by Federal Law No. 14 of 1995 on Narcotics and Psychotropic Substances.

Under this law, any form of promotion, sale, or encouragement of the use of such substances is illegal, even if the discussion is for educational purposes.

Here are key points to consider:

- Controlled Substances:

Psychedelics such as psilocybin are classified as illegal narcotics in the UAE. Possession, trafficking, or usage of such substances can lead to severe penalties, including imprisonment.

- Public Discourse and Media:

Public discussion or promotion of illegal substances, even in a research or clinical context, could be interpreted as promoting or encouraging the use of those substances. This might be seen as an offense under the country’s media and drug laws.

- Legal Boundaries:

While academic and scientific discussions in controlled settings (like licensed conferences) may occur, promoting these topics on a public platform like a podcast might still be subject to scrutiny.

Even if the intention is to discuss legal or clinical research, you could face risks if it is perceived as indirectly promoting the use of controlled substances.

For a podcast, ensure that the language used is clear, and make sure the discussion stays strictly within scientific and legal boundaries.

To mitigate risks, it’s essential to seek specific legal advice and possibly get approvals if the podcast touches on these sensitive subjects.

Dear questioner,

According to UAE laws, narcotic and psychotropic substances, including psilocybin, are strictly regulated under Federal Law No. (14) of 1995 on Combating Narcotic Drugs and its amendments.

While there have been scientific discussions on psychedelic drugs in some medical conferences, publicly discussing such topics—especially on a platform like a podcast—could be considered incitement or promotion of drug use, which is punishable under Article (43) of the law.

Therefore, it is advisable to seek specialized legal consultation before launching the podcast to ensure full compliance with the applicable laws and regulations in the UAE.

Thank you for reaching out with this interesting query!

The legal landscape in the UAE regarding discussions on psychedelics is quite strict, as any content related to controlled substances, even from an educational or research perspective, can be subject to regulatory scrutiny.

While there have been instances where medical conferences have touched on psychedelic research in a controlled setting, public discussions—especially on a widely accessible platform like a podcast—may raise legal concerns under UAE's cybercrime and anti-narcotics laws.

Before proceeding, it is crucial to ensure compliance with UAE regulations to avoid potential legal issues.

I can guide you on the necessary precautions and any approvals you might need to legally discuss this topic. I strongly recommend a consultation to review your podcast’s content framework and mitigate any legal risks.
