Questions & Answers
Can I leave my job without notice if my employer delays my salary and does not provide work?
Hello,
Can I leave my company without any notice? For 8 consecutive days, they haven’t given me a location to work.
I need money for rent, food, and other expenses. Are they obligated to pay me even if the company hasn’t given me work?
Salary is always late, and they lie about why it’s delayed. There’s also a lack of insurance.
Please, I need advice!
Dear Client,
Thanks for your question! I hope you are doing well. I will assist you in this matter.
Based on UAE labor laws, you may have grounds to leave without notice due to your employer's violations:
1. Not providing work for 8 days.
2. Consistently late salary payments.
3. Lack of insurance.
Your employer must pay you for the days you were ready to work, even without assigned duties. Before leaving:
1. Document all instances of non-payment, late payment, and workless days.
2. File a complaint with the Ministry of Human Resources and Emiratisation (MoHRE).
3. Consider escalating to the employment tribunal if unresolved.
You can seek new employment, but consult MoHRE or a legal professional first to ensure you follow proper procedures and protect your rights.

Dear Questioner,
Under UAE labor law, you have rights as an employee, and your employer has obligations they must fulfill. Based on your situation, here are key legal points to consider:
If your employer is consistently delaying salary payments or failing to pay, this is a violation of Federal Decree-Law No. 33 of 2021 on the Regulation of Labor Relations.
You have the right to file a complaint with MOHRE (Ministry of Human Resources & Emiratisation) to claim your unpaid wages.
Even if your employer has not given you work for eight consecutive days, they are still obligated to pay your salary as per your contract. You can file a labor complaint if they fail to compensate you.
UAE labor law allows employees to resign without notice in certain situations, including when the employer fails to pay salary for more than two months or breaches contractual obligations, such as not assigning work, delaying salary payments, or failing to provide insurance. It is important to document all violations, such as salary delays, messages showing lack of work, and proof of financial hardship.
To take action, you should file a complaint with MOHRE through their website or hotline. You may be eligible to terminate your contract without penalty and claim unpaid dues. If your employer is violating labor laws, they may face fines or restrictions.

Dear questioner,
It is the employer's fault because they need to assign work. If there is no work, they either need to terminate you or continue paying your salary, as denial of salary is not legal.
If you wish to terminate your job, it is advisable to do so after filing a complaint with MOHRE.
If you need further clarification, kindly share your WhatsApp number.
Under UAE law, if you are not provided with work, you can file a complaint with the Ministry of Human Resources and Emiratisation.

In most jurisdictions, employers have a legal obligation to provide work for employees. If there's no work for you, they either need to find you suitable tasks or terminate your employment.
Withholding your salary without valid reasons is illegal. Even if there's no work, you're entitled to your wages for the hours you've worked.
If your employer refuses to pay you or provide work, you can file a complaint with the Ministry of Human Resources and Emiratization (MOHRE).
Thank you for reaching out with your concerns!
I understand how stressful it can be to face difficulties with your employer, especially when it comes to unpaid salaries and job obligations.
To address your questions:
1. Leaving Without Notice:
Generally, under UAE labor law, employees are required to provide notice if they plan to resign. However, if your employer has not provided you with work for consecutive days without a valid reason or failed to pay your salary, this could constitute a breach of contract. In such cases, you may be entitled to leave without serving the usual notice period.
2. Salary and Work Issues:
Regarding salary delays, your employer is legally obligated to pay you on time as per your employment contract.
If the company consistently fails to meet this obligation, you may have grounds for legal action. Additionally, if they are not providing you with work as agreed, you might be entitled to compensation for the period you were left without tasks.
3. Lack of Insurance:
Employers are required to provide health insurance for their employees in the UAE, so the absence of such coverage could be a violation of your rights.
Given the nature of your concerns, I recommend scheduling a consultation where we can discuss the specifics of your employment contract, your situation, and the best legal course of action to take.
We can explore options such as filing a complaint with the Ministry of Human Resources and Emiratisation (MOHRE) or pursuing a claim for unpaid wages and other entitlements.
