Can I upgrade and gift an apartment to my husband after evicting a tenant?
Hello,
I purchased a property last year that was already rented. I then issued the tenant an official notarized eviction notice of one year. The tenant has now vacated the apartment.
I plan to upgrade the apartment and gift it to my husband. Will the former tenant have any legal rights against me if I proceed?
The apartment was listed for sale, but we haven’t received a reasonable offer, so we decided to refurbish it.

- The landlord’s desire to demolish the property to rebuild it or carry out comprehensive renovations.
- The landlord or a first-degree relative needs to use the property for personal residence.
In these cases, the landlord must notify the tenant via notary public or registered mail 12 months prior to the eviction date.
