Can a black-and-white trademark registration provide protection for all color variations of a logo?

We are currently reviewing trademark registration strategies for the United Arab Emirates (UAE) and seeking expert confirmation on a specific matter.

It is generally understood that registering a trademark in black and white in the UAE provides protection across all color variations of the logo. This approach aligns with international norms.

While the UAE’s Federal Decree-Law No. 36 of 2021 on Trademarks does not explicitly state that black-and-white registrations cover all colors, this practice is widely accepted and typically adhered to by the UAE Ministry of Economy’s Intellectual Property department.

Could you please confirm if a black-and-white trademark registration in the UAE indeed provides protection for all color variations of a logo, specifically regarding the broad protection scope covering the mark’s shape, design, and layout?

Black-and-white marks give the applicant/owner the flexibility to use the mark in any colors they see fit but without being exclusive to any particular color.

Whereas a color trademark owner can use the mark in a combination of those colors only.

While the UAE Trademark Law doesn't explicitly state that a black-and-white registration covers all color variations, it's a widely accepted practice that such a registration provides broad protection for the essential features of the trademark, including its shape, design, and layout.

If color is a significant distinctive element of the trademark, it might be advisable to register the trademark in specific colors to ensure maximum protection.

While black and white registrations provide a solid foundation, enforcing rights against color variations might require additional evidence to establish infringement, particularly if the color scheme is highly distinctive.

If you need further clarification you may ask.

Dear S.,

Thanks for your inquiry.

According to the UAE's Federal Decree-Law No. 36 of 2021 on Trademarks, a trademark registration in black and white does not explicitly provide protection for all color variations of a logo.

However, it is generally accepted and practiced by the UAE Ministry of Economy's Intellectual Property department that a black-and-white registration does provide protection for all color variations of a logo, including the mark's shape, design, and layout.

This approach aligns with international norms and is widely accepted in the UAE. It is recommended to consult with us as a legal expert by phone or email for specific advice on trademark registration strategies in the UAE.

Dear questioner

Yes, the black-and-white registrations of logo marks cover all colors.

However, if the specific color scheme of your logo is a crucial aspect of your brand identity and you want to obtain exclusive rights to that particular color combination, you may want to consider registering a separate color trademark.

If you need further clarifications kindly share your Whatsapp number.

Thank you for reaching out with your inquiry regarding trademark registration strategies in the United Arab Emirates (UAE). I appreciate the opportunity to provide clarity on this matter.

In the UAE, registering a trademark in black and white generally offers protection across all color variations of the logo.

This practice aligns with international norms and is typically adhered to by the UAE Ministry of Economy’s Intellectual Property department.

By registering in black and white, the protection extends to the mark's shape, design, and layout, irrespective of the colors used in actual use.

However, if a specific color is a distinctive and essential feature of your trademark, it is advisable to register the mark in that particular color to ensure comprehensive protection.

This approach safeguards the unique color aspect of your brand identity.

For a more detailed discussion tailored to your specific situation, I invite you to contact me via WhatsApp or phone. I would be pleased to assist you further.

Best regards,

In the UAE, registering a trademark in black and white is considered sufficient to protect it in all colors and color variations.

This is in line with international practice, whereby a black-and-white registration is assumed to cover all possible colors of the mark.

Although Federal Decree-Law No. 36 of 2021 on Trademarks does not explicitly state this, this practice is widely accepted and enforced by the Intellectual Property Department of the UAE Ministry of Economy.

Therefore, when you register your trademark in black and white, you will receive protection covering all colors and color variations of the logo, providing a broad scope of protection that includes the shape, design, and layout of the mark.

Welcome.

Yes, it is generally accepted that registering a trademark in black and white in the UAE provides protection for all color variations of the logo.

This practice aligns with international norms, and although the UAE’s Federal Decree-Law No. 36 of 2021 on Trademarks does not explicitly state this, the UAE Ministry of Economy’s Intellectual Property Department follows this standard.

A black-and-white trademark registration typically covers the mark’s design, shape, and layout in any color.

Therefore, as long as the core design remains the same, any use of the logo in different colors would still be protected under this registration.

The laws do not regulate every detail as they are too numerous.

Generally, and according to court rulings, the focus is on the similarities between the trademarks, not the differences.

Therefore, if a trademark exists in black and white and there is an almost identical mark with slight differences, this is legally unacceptable.
