Questions & Answers
Does the Abu Dhabi Family Court have jurisdiction over my U.S. assets in the divorce?
Hello,
Both my (now) ex-wife and I are Americans and non-Muslims living in Abu Dhabi. We are going through a divorce in the Abu Dhabi Family Court. My ex-wife is suing me for a (very large) financial support package, and I am being asked to disclose my personal financial information.
Two questions:
1. Do the courts have any jurisdiction over the USD assets I hold in the USA?
2. Am I required to reveal any information about my company, which is an independent legal entity based in the USA?
Thank you!
Greetings,
The UAE judiciary is not competent in the matters and funds of a company located in America.
We are honored to provide you with legal support.

Dear Questioner,
The Abu Dhabi Family Court has limited jurisdiction over USD assets located in the USA.
While they can consider these assets for financial support determinations, enforcing orders related to them may require additional actions.
You may be required to disclose information about your company if it affects your financial situation relevant to spousal support claims.
It is advisable for you to consult with a lawyer who specializes in family law within the UAE jurisdiction for tailored advice regarding what specific documents you must provide concerning both personal finances and business interests.
Please contact us via phone or email.
Dear Questioner,
The Abu Dhabi court may take your global financial situation into account when determining spousal support or other financial obligations, but it cannot directly seize or control assets in the US.
Any enforcement of a ruling involving foreign assets would need to go through a separate process in the US.
If your US-based company is legally structured as an independent entity (e.g., LLC, corporation), the court typically does not have jurisdiction over the company itself.

Dear Questioner,
Thanks for your inquiry!
Regarding the above, and according to UAE law, the courts do have jurisdiction over any assets that you have in the UAE, regardless of their currency.
This means that the court can consider your USD assets in the USA when determining the financial support package for your ex-wife.
As for your company, if it is a separate legal entity and not directly related to your personal finances.
You may not be required to reveal information about it. However, the court may still request this information if it is relevant to the case.
It is best to consult with us as a lawyer for specific advice on how to handle this situation.
Kindly do not hesitate to contact us via phone or email for further guidance.
Greetings,
Dear Questioner,
While the Abu Dhabi Family Court has jurisdiction over matters related to your divorce, its jurisdiction over your US-based assets might be limited.
UAE courts generally have jurisdiction over assets located within the UAE. However, they may also have jurisdiction over assets located outside the UAE if those assets are closely connected to the marriage or the parties' residency in the UAE.
You don't have to disclose anything regarding your company as it's a separate legal entity.
We will let you know how the court will be proceeding in this matter based on the precedents.
Kindly share your WhatsApp number so we can discuss this further.

Dear questioner,
Your wife can submit information about your USD assets to the courts, but this is challengeable with effective strategies.
If your wife has her own income and assets in the UAE as well as in the U.S., we can potentially reduce the maintenance amount.
If you need our assistance in reducing the claim amount or defending yourself in the case, kindly share your WhatsApp number.
Hello,
As per your query, please note that the court's jurisdiction may depend on the actions taken by your wife and the documents submitted by her.
You may not need to reveal everything and can present the liability as much as possible.
Please email or call me.
Hello,
Thank you for reaching out and sharing your situation!
I understand how complex and sensitive these matters can be.
To address your first question, while Abu Dhabi Family Courts primarily exercise jurisdiction over matters within the UAE, they can consider global assets when determining financial settlements, especially in divorce cases.
However, enforcement of any order concerning assets in the U.S. would typically require separate legal action in U.S. courts, depending on treaties or agreements in place between the two countries.
Regarding your second question, while the court may request disclosure of your financial status, the requirement to disclose company information, particularly about an independent legal entity based in the U.S., depends on the specifics of the case.
Courts generally focus on personal income and assets but could inquire about business ownership or income derived from it.
I recommend booking a consultation with me to review the specifics of your case and ensure your interests are fully protected.
