Terminating lease contract due to complaints about cooking odors

Dear Lawyers,

Is it legal for a landlord in Sharjah to terminate your lease contract after only one month due to some tenants not liking the smell of your cooking?

Additionally, is it legal for the notice to vacate to be only 25 days? Furthermore, can they charge you rent for the number of days until you provide SEWA Clearance?

How can I lodge a complaint against this landlord in Sharjah?

Dear Questioner,

No, that situation is not legal according to Sharjah tenancy laws.

Landlords in Sharjah can only terminate a lease early under specific circumstances, and a tenant's cooking smells are not one of them.

A 25-day notice to vacate is not sufficient in Sharjah. Landlords must provide a minimum of three months' notice for early termination (unless the tenant breaches the contract).

If you need further clarification, kindly share your WhatsApp number.

Dear Client,

In Sharjah, landlords cannot legally terminate a lease contract for minor reasons such as cooking smells.

If you received a 25-day notice to vacate, document all communications and review your lease agreement for specific terms.

File a complaint with the Sharjah Rent Dispute Committee. The demand for rent until SEWA clearance is also questionable and should be addressed through these channels.

We can have a quick call to discuss this further. I am available on [------] and email at [--------].

Dear Questioner,

Thanks for your inquiry!

Regarding the above, we would like to inform you that, according to UAE law, a landlord cannot terminate a lease contract after only 1 month without a valid reason.

Cooking food with a certain smell is not a valid reason for the termination of a lease contract. The notice period for termination of a lease contract in Sharjah is usually 3 months unless otherwise stated in the contract.

If the landlord has terminated the lease contract without a valid reason and with a shorter notice period, you can file a complaint with the Sharjah Rent Dispute Settlement Committee.

You can also seek legal advice from a lawyer to understand your rights and options in this situation.

Additionally, the landlord cannot charge you rent for the number of days until you provide a SEWA Clearance. The landlord can only charge rent until the end of the notice period or until a new tenant moves in, whichever comes first.

It is important to review your lease contract and understand your rights as a tenant in Sharjah. If you feel that your landlord is not following the proper procedures or is violating your rights, you can seek legal assistance to protect your interests.

Kindly feel free to contact us at [-----] for further inquiries.

Dear Questioner,

If the landlord's claim is malicious and without evidence, he cannot evict you from the apartment except for the reasons stipulated in the law.

Therefore, you must file a lawsuit against the owner.

Dear Questioner,

According to the UAE Rental Law, a landlord cannot terminate a lease contract without a valid reason. In this case, the reason given by the landlord, that some tenants do not like the smell of your food when you cook, may not be considered a valid reason for termination.

If you believe that your landlord's action is unjust or illegal, you can file a complaint with the Sharjah Real Estate Regulatory Agency (RERA).

You can contact RERA through their website or by visiting their offices in Sharjah. They will be able to provide you with guidance on how to proceed and may intervene on your behalf.

Additionally, you can seek legal advice from a lawyer specializing in real estate laws in Sharjah to understand your rights and options in this situation.
