An Ajman company driver died in a Sharjah accident. Which court for insurance?

Dear Sir/Madam,

Our company driver passed away in a road accident. He hit a heavy truck from behind and died on the spot. His family is in his home country. I have obtained the legal heirship certificate and had it attested.

The insurance company requires a letter from the court mentioning the amount to be disbursed. The policy clearly states AED 200,000.00 in case of death.

That is what we are hoping they will pass on to the family. Which court should we approach in this case?

The accident occurred in Sharjah, and the company is based in Ajman.

Your advice would be greatly appreciated!

Dear Questioner,

Thanks for your inquiry!

Regarding the above, we would like to inform you that, in this case, you should approach the Sharjah Court to obtain a letter mentioning the amount to be disbursed to the family.

This is because the accident occurred in Sharjah and the driver was employed by a company based in Ajman.

The Sharjah Court will have jurisdiction over the case. You may also need to provide the legal heirship certificate and any other relevant documents to support your claim.

It is advisable to seek the assistance of us as a lawyer to help you with the legal process.

I have got a letter from the Ajman court mentioning the insurance company to pay whatever is required from their side to the legal heirs, but that is not accepted by the insurance company.

Dear Questioner,

Thank you for reaching out to me regarding the unfortunate incident involving your company driver. I extend my heartfelt condolences to you and your team during this difficult time.

Based on the information you've provided, it's essential to take the necessary legal steps to facilitate the insurance claim process for the benefit of the deceased driver's family.

Given that the accident occurred in Sharjah and your company is based in Ajman, the appropriate jurisdiction for this matter would be the Sharjah Court.

To initiate the process, I recommend that you file a claim petition with the competent court in Sharjah. This petition should include the legal heirship certificate you've obtained and any other relevant documentation supporting the claim for the insurance amount of AED 200,000.00, as stipulated in the policy.

Upon receipt of the claim petition, the court will review the documents and issue a letter specifying the amount to be disbursed to the family of the deceased driver.

This letter will serve as the official authorization for the insurance company to release the funds.

I understand the urgency of this matter, and I am here to assist you every step of the way.

Please feel free to reach out to me via WhatsApp or phone to discuss further details and to ensure a smooth and timely resolution.

Thank you for providing additional details regarding the letter from the Ajman Court and the ongoing dispute with the insurance company regarding the insurance claim for the deceased company driver.

I understand the frustration and urgency in resolving this matter promptly for the benefit of the legal heirs.

Despite the letter from the Ajman Court, it seems that the insurance company is not accepting it as sufficient documentation for releasing the insurance amount.

In light of this situation, I recommend taking the following steps to address the dispute:

- Clarification with the Insurance Company:

Initiate direct communication with the insurance company to understand the specific reasons for their refusal to accept the letter from the Ajman Court. Request clarification on their requirements and any additional documentation they may need to process the claim.

- Legal Representation:

Considering the complexity of the situation, it may be beneficial to engage legal representation to advocate on behalf of the deceased driver's family. As an experienced attorney, I can assist you in negotiating with the insurance company, presenting legal arguments, and ensuring that your rights are protected throughout the process.

- Formal Appeal:

If informal negotiations do not yield a satisfactory resolution, we may need to escalate the matter by filing a formal appeal or legal action against the insurance company. This could involve presenting the case before the appropriate legal authorities to enforce the rights of the legal heirs and compel the insurance company to fulfill their obligations under the policy.

I am committed to providing you with comprehensive legal support and guiding you through each step of this challenging process.

Please do not hesitate to contact me via WhatsApp or phone to discuss further strategies and options for resolving the dispute effectively.

If legal action is taken in the Emirate of Sharjah at the site of the accident, the Sharjah Court will be competent to hear this dispute.

In this instance, you need to contact the Sharjah Court to acquire a letter specifying the payout amount for the deceased driver's family.

This is because the accident took place in Sharjah, and the driver worked for an Ajman-based company.

The Sharjah Court has jurisdiction over such cases and can issue the required letter to the insurance provider.

It's essential to submit the legal heirship certificate and any pertinent documents to the court to strengthen your claim for the insurance sum.
