Previously, if a person was charged with a criminal offence or has a complaint filed against him at the police station, his passport or the passport of another person bailing him out was confiscated until his release.

In November 2018 the Dubai Public Prosecution's Smart Bail initiative was implemented across in all police stations across Dubai - in which passports of defendants are no longer confiscated under the criminal case.

One must understand that a criminal case is purely a punishment for a criminal act i.e. issuing a cheque without sufficient balance.

Now, in certain cases, especially if the amount is less than 200000/- criminal liability ends upon payment of a fine but the civil liability towards the debt remains unless otherwise paid or waived.

The Smart Bail does not lift the travel ban. The travel ban will remain until the case is settled by the court with a final verdict, which is then executed or dismissed by the public prosecution.

But ma’am, do rental cheques fall under criminal offences?

Cheque returning as unpaid is a criminal offence. It does not matter for what.
