Questions & Answers
Is it mandatory to wait for 30 days from the date of judgment to implement a divorce judgment?
I'm a plaintiff (husband). On the 7th of Mar 2024, the first instance divorce judgment was provided based on Article 7 of federal law 41 of 2022 and based on Article 133 of civil code proceedings.
The defendant (wife) was requested to pay expenses and fees.
Please advise me on the following questions:
Is it mandatory to wait for 30 days from the date of judgment (the waiting period will end on the 7th of Apr 2024) to implement the ruling?
What is the implementation of the ruling? Is it mandatory to raise this request?
What are the documents or concerns that can be shared during the request to implement the ruling?
What's the process and procedure?
Yes, It's mandatory to wait 30 days from the date of judgment to implement this ruling and the request as well.
The execution procedures can be done by submitting a copy of the judgment duly attested and certain other documents related to the case.
In order to advise you properly, we need some more details. It would be better if we could discuss everything in a legal consultation session.
Greetings.
There are provisions that are subject to expedited enforcement, and there are provisions that must be given an executive formula before their implementation.
Can you share the ruling, so that we can inform you correctly?

1. Is it mandatory to wait for 30 days from the date of judgment (the waiting period will end on the 7th of Apr 2024) to implement the ruling?
Yes, it is mandatory to wait for 30 days from the date of the judgment before implementing the ruling. This is known as the appeal period, during which either party can appeal the judgment.

Implementation of a ruling means carrying out the orders and decisions stated in the judgment. It is not mandatory to raise a request for implementation, as it is the responsibility of the court to ensure that the ruling is implemented.
However, if there are any issues with the implementation, either party can request the court to intervene and enforce the ruling.

During the request for implementation of the ruling, the party requesting it may need to provide documents such as the original judgment, proof of payment of any fees or expenses, and any other relevant documents related to the implementation of the ruling.
Concerns related to the implementation, such as non-compliance by the other party, can also be shared during the request.
4. What are the process and procedure?
